Yesterday I have received an answer from HMSP for my query on 'HSMP retrospective changes' and the answer is encourgaing..See below answer from HMSP Team...

Thank you for your e-mail,

Thank you for your enquiry regarding the recent Judicial Review relating to the

changes to the HSMP extension processes.



What does the ruling mean for those affected in practical terms?



We will offer a remedy for those affected in line with the judgment.

The practicalities will be announced as soon as possible.





But when will you announce the practicalities?



We want to make sure we give the arrangements due consideration so that they

work as smoothly as possible after they are announced. We have interim

measures to deal with individual cases as they arise.

Whilst I'm really trilled for those of you, who are on HMSP visas, and will benefit from this ruling.

There is no mention of those poor sucker on WP,AV and a few other categories, who have had to extend thier visa's for a additional year and paid £500.

I wonder if we will be entitled to any compensation ha, ha, ha????

And what about the guys who were/are on HSMP and had to extend their visas by a year and are nearing completion of the forced additional year before applying for ILR?

I have called Home office customer service to check about high court ruling impact on hsmp extension.

Initially they told me that i need to fill tier1 form, then i told them about High court ruling and home office letter to HSMPForum, then they said that today or early next week homeoffice is uploading full clarity for people who are on HSMP and have entered before Nov 2006. This can mean new forms or new exceptions for us.

So he was not sure as to should i fill tier 1 or not, he then asked me wait for 1 week and check what information is being uploaded at homeoffice website.
