Minimum salary question - very confused!

Hi all,

I am confused and stressed about the salary component of the tier 2 Visa application. I have been granted a COS, with salary of £29452(incl. HCLA). I am a physio, and the job is band 6 NHS post. Working hours 37.5 p/w. The COS is for 3 years. I am 27 years old. I have not yet applied for my Visa as I await IELTS results.

1. Will the salary be adjusted and calculated to 39hours p/w as per normal standards?
2. Is there any circumstances that allow NHS physios to earn below the £30k threshold?
3. Can I ask my employer for a possible £548 bonus to make the total salary £30000? And will this require a new COS?
4. Does the fact that it is a 3-year COS help my situation in any way?
5. Should I be worried? :cry:

Please help. I am super stressed about this and getting mixed answers. Thank you!

What's the SOC code and it's salary requirements for this role?

SOC code 2221, minimum salary according to bands (table 9 of appendix J) - for me it is Band 6 = £28050.

Band or equivalent England Scotland Wales Northern Ireland
Band 6 £26,565 £26,830 £26,566 £26,301

Based on band 6 you need a minimum of £26,565 (assuming job is in England) for 37.5 hrs/week.

You indicated your salary is £29,452 for 37.5 hrs/week, so your offer is more than minimum salary requirements... So what's your worry?

Thank you srsw, however my concern lies with the sentence "whichever is higher". So between the band scale and the £30k, the £30k is obviously higher. That is why I am wondering if there is any exclusion for NHS bands or my situation. But I guess I will just have to take the chance to apply and hope for the best!

Where did the £30K come from? Can you provide more details about your case and the sources you are using? £30K may be a requirement for ILR, but it shouldn't have anything to do with if your application is for Tier 2 visa.

You need to provide all the details for us to help you out here. I've checked the salary requirements for Band 6 and as far as I understand there is only a minimum salary requirement.

It is clearly stated that your salary must be £30k pa or what is stated in the SOC, whichever is higher, to apply for a Tier 2 visa. However as far as I understand, certain NHS jobs are not required to meet this minimum £30k.

Appropriate salary
You’ll usually need to be paid at least £30,000 per year or the ‘appropriate rate’ for the job you’re offered - whichever is higher. Check the appropriate rate for the job you’ve been offered.

Check the guidance for situations when you can be paid less - for example if:

you’ll work as a medical radiographer, nurse, paramedic or secondary school teacher in some subjects
you’ll work as a pre-registration nurse or midwife

In that case, rather than completely leaving it on chance, why don't you point out your concern (provide them with UKVI sources that CR001 provided) to your future employer? They may adjust the salary or assign a new CoS if they got the salary wrong. Employers don't want to issue CoS and get the application rejected if the salary requirements won't be met.

Either your employer will say this job doesn't need to meet the £30k requirement (based on previous applications they may have supported), or will adjust the salary. Ask them for advice before you apply.

I am in the same situation as you.

Hence just wondering what was the outcome of your Tier 2 visa application.

Did you employer increased the salary to £30k or did you apply with original slalry offered?

I did, but they did not seem to know about the rule. Thay did not at all attempt to raise my salary.
