ILR qualifying period for Tier 1 Dependent

I am planning to apply for the wife's ILR. My understanding is ILR application can me made on completion of 5 year qualifying period, my questions are:

1) When does the qualifying period start? Does it start from the date she was first granted the visa or the date she arrived in the country?

2) Can she apply 28 days before completion of her qualification period? Her current visa will not expire for another 1 year.

5 Qualifying period finishes on 13/12/2018

I trying to fill the online form Set (O) for my wife. What does Leave granted on or after 11 January 2018 mean?

Question in application:

Does the period of stay on which this application was based include any leave granted since 11 January 2018?

It means a visa issued after 11th January 2018.
Question in application:

It would be No.

She was given an extension of tier 1 dependent visa on 13 March 2018 which is valid till 2021.

Would that mean I should mark it as yes.

Also, Does she need to provide evidence of your absence from the UK and Crown Dependencies considering she is a dependent?

Also how do I fill the field in the form if its not applicable?

I am planning to apply ILR for my wife under Tier 1 (dependent) category

My understanding is that the qualifying period ends on 5 year from the date of the first time she was issued the visa (December 2013). She entered the country in 13 Jan 2014

In the 'immigration history' section there is a question:

When did you first enter the UK?

Other than that there is no reference to her first visa.

Similarly I also check the PDF form: In section 6.12 When did you (the dependant) first enter the UK? This refers to the date you entered the UK at the beginning of the period of stay on which this application is based.


I am confused, as to how the Home office will determine if she has completed her qualifying period, when there is no reference in the application to the date the first visa was granted.

Could you please advise.

You write the date she entered as the question asks. It is not a trick question.

HO know the rules, you don't to point them out and they can see her full immigration history on their system!!
