Does this apply to dependent applying ILR as well?

@CR01 I understand we should not put our questions in someone else thread. However,Please advise on I had the above question about ILR maintenance now if I have any other question related with ILR ,different questions comes across in the due course of preparation,how would I raise them in one topic,
Should we use general headings?
Sometime the topic itself helps someone looking for particular query. I lost the privilege of PM services a year ago,don’t want to be thrown out of immigrations board forum.

Thanks and I do understand the efforts ,energy and time it takes to manage such a big forum.

ILR application with still 5 months extension Valid Visa

Hi
I would appreciate some feedback on,

If one applies (with 5 month of valid extension visa) for ILR (assuming he/she is eligible to apply) and God forbidden,it gets rejected.

How does the rule for admin review OR fresh application works?

1-Will he/she be able to wait and reapply just before expiry date?

2-Will that application be considered second (irrespective of AR used or not)

I hope I did not complicate the simple question☺

1-Will he/she be able to wait and reapply just before expiry date? 14 days to reapply wont be mentioned, i guess
If you apply before the visa expiry it will be in-time and you get section 3C. If you choose AR and in meantime your valid leave ends and then you apply within 14 days of an AR conclusion, your application will be out-of-time and become an overstayer.
However If your AR is concluded and your leave still has not expired, well AR will not kick the section 3C at all and so you can apply before visa expiry and that will be an in-time application
2- If so ,will that application be considered second ?(my assumption is Y)
Every application will be considered as long as it is not invalid
3- How does the AR will work in that scenario? especially if he/she reapplies second time just before expiry?Will he/she be given the chance of AR after second application

Just a minor clarification. Section 3C leave comes in only if the current leave expires before a decision is made. So, in OP's case, unlikely to be in Section 3C.
Effectively, if the application is refused, it continues as though there has been no such application, i.e. no impact at all. The current leave just continues.

What I want to understand is that as long as you have a valid leave(any application if rejected will have no impact on your-current leave and section 3C is not triggered at all and also 14 day rule/AR come into play only if current leave expires in due course)

I promoted someone from being an “Assitant Management advisor” to the “Management Consultsnt/Management advisor” (after good few years)

Will that be counted as another Job creation from that date?

This is something that is not very clear in the immigration rules. But it definitely goes against the spirit of the rules.
It would be very tough to argue that a promotion is a new job because what the person is doing would be very similar activity.
If the job was very different, say from a driver to sales manager , then I think it is easier to argue but will still likely to be very difficult.

I would like to know how should a Table be completed for Job 1:

Initial Start Date :10/10/2013

Period to be Claimed: Start Date: 02/10/2017(after Extension)for ILR- employee has been with us since the initial start date.

Should I put 10/10/2013 and comment in brackets as Initial with no End Date.

Then start Again with a new Start Date 02/10/2017 and End Sep 18(Rate Change to £12/h)
Then again Start date of 1st August and End date to Last Claiming month , if there is no further changes in hourly rate.

You would just fill in the table from the start date (10/10/13) and make new rows for each different hourly rate after 2/10/17. You are only going to submitting pay documents starting from Oct 2017

In each row, the end date is the last date of a particular hourly rate.

Rate changes before your claim period are irrelevant.

The first row could just end with the date of the last hourly rate before your extension. You can the just fill £6.5-£7.35 or whatever the numbers hour in the hourly rate column.

Not since we arrived in the country?

Arrived in 2010
TIer1 E since March 2014
