Spouse Visa Financial Requirements

Post by shazi-uk » Mon Oct 22, 2018 10:02 pm

Hi,

I’m a single full-time mother (on DLR with RPF) living with 2 children (both are British), claiming benefits and working part-time, I’m on low income. Considering my financial situation, is it possible for me to get married to someone in Pakistan and apply for his spouse visa etc.?
Due to childcare duties I can’t work full-time, do I still need to show high income?
Are there any exceptions?

Thanks

What benefits do you claim??

You also need ILR first before sponsoring a spouse

Housing, council tax and tax credits

Oh OK so at the moment on DL I can't...

So until I get ILR I can't get married?
How much do I need to show?

You can get married, nothing stopping you from doing that but you cannot sponsor a spouse till you have ILR.

You need to show evidence of meeting the financial requirement of £18,600pa with bank statements and payslips for a minimum of 6 months. You cannot use your benefits you claim towards the financial requirement.

Understood, It's like one can buy the car but can't drive it until he/she gets the license :o

Don't I need to show additional funds in regards to two children?

Only if the children do not hold ILR or British citizenship.

Thanks for your response and clarifications.

so I can go and marry someone but at the time of making application I need to show £18600?
Do I need to show that I have £18600 in my account for last 6 months?
Can my spouse add his savings or salary into this/ Will it count towards £18600?
What about future earning potential? as I don't think we will be applying for any benefits in the future as we both will be able to work around and earn more.

CR001 : please can you look into this as well

You can marry in Pakistan anytime but when it comes to applying for your husband you will need to show you meet certain criteria including financial.

If your going to Pakistan to get married then I presume you have had kids already with someone else like a previous marriage.

Your kids will not need entry clearance as they are already in UK with you so you only need to show £18,600 at the time of application. Or you will need to show cash savings of £62,500 which have been held in a account for at least 6 months. This can be your account in UK or Pakistan account of your spouse.

Yes, if you are relying on savings only.

Don't get confused from £18600 and £62500. If you meeting financial requirement by employment then your annual wages should be at least £18600 and if you are willing to meet the financial requrirement though having savings then it should be at least £62500 but 6 months old.
