Tier 2 General Dependant Visa Funds

Post by avaismohammad » Thu Nov 15, 2018 12:18 pm

Hi Guys,
Really confused with what people mentioned with maintaining funds saying keep atleast 2k bla bla etc...
I am on a Tier 2 General since 4 years and going to bring my wife-to-be in UK (inshallah)
Since I am not applying with her do I have to show the £945 for me in my account or just the £630 is enough evidence for her

https://www.gov.uk/tier-2-general/family-members
Actual calculation: https://assets.publishing.service.gov.u ... 018_2_.pdf (page 15)

"For example, the Tier 2 Migrant is making an application at the same time as their spouse (which I am not) and
two children (no children). They must show that they have £630 for their spouse and a further £630 for each
child, in addition to £945 required for their own support. In total the family will require evidence
that they hold £2835 in available funds (£630 x 3 = £1890 + £945)."
p.s. Text in bold are my comments..
Any help much appreciated...

Tier 2 Dependent visa queries - please help

Post by avaismohammad » Wed Nov 21, 2018 11:46 pm

Hi, I am on a Tier 2 General visa for 4 years working as software developer. I am planning to bring my wife-to-be in January. A few hurdles I stumbled across:
1. She does not have a surname (surname is blank) on her passport, what do I put in her application form surname.
2. Does she need a criminal record certificate?
According to PBS Dependent Guidance she needs it if her sponsor (me) is under the mentioned soc codes (below) or those does not apply to her and she needs a criminal certificate anyhow?

Code: Select all

1181 - Health services and public health managers and directors
1184 - Social services managers and directors
2211 - Medical practitioners
2212 - Psychologists
2213 - Pharmacists
2214 - Ophthalmic opticians
2215 - Dental practitioners
2217 - Medical radiographers
2218 - Podiatrists
2219 - Health professionals not elsewhere classified.
2221 - Physiotherapists
2222 - Occupational therapists
2223 - Speech and language therapists
2229 - Therapy professionals not elsewhere classified
2231 - Nurses
2232 - Midwives
2312 - Further education teaching professionals
2314 - Secondary education teaching professionals
2315 - Primary and nursery education teaching professionals
2316 - Special needs education teaching professionals
2317 - Senior professionals of educational establishments
2318 - Education advisers and school inspectors
2319 - Teaching and other educational professionals not elsewhere classified
2442 - Social workers
2443 - Probation officers
2449 - Welfare professionals not elsewhere classified
Please help me, unable to sleep thinking of this..
Thank you

Hi Awais

I am replying to your first message about the maintenance requirements.

You don't need to show £945 for yourself if you are not applying for your visa.
When i applied for my wife's VISA, I just showed about £1500 for my wife and my child and they both got the visa straightaway.

Guidance clearly states if Tier 2 Migrant (i.e. you) is applying the visa with the family then you are required to show £945. Otherwise, if you are not applying for visa along with your wife, then you are not required to show £945.

Please remember, you must send the original bank statements from bank and NOT the online ones. I downloaded the statements online and took the statements to the bank for the stamp.

I am sure you would know that you need to prove the subsisting relationship with your wife. DO NOT rely on PBS dependant guidance only as the guidance doesn't state any thing about the subsisting relationship. There used to be another set of guidance which i can't find now.

You may be able to find the link on some other forms.

I hope that helps and your wife gets the VISA insha ALLAH.

Talha

Awais
I have just read the guidance. It states criminal certificate is required if Tier 2 General Migrant is working under specific SOC codes.
If your SOC code is what you mentioned in your previous post, then she does needs a criminal certificate. Otherwise not.
Please clarify your SOC code on your cos.

Thanks Talha.
Although I am not in those SOC Codes but I am going to ask her to get certificate from a local police station. Better safe than sorry :)

Appreciate your time and comment bro..

Hi Londoner007,
Thanks for replying back.
It is for my wife so, lets say it is "ABC DEF XYZ" as her full name.
There is no surname separate field on the certificate.
Any help much appreciated.

Jazakallah

Now am confused... ABC DEF XYZ is 3 names.

Does your wife have more than 2 names mentioned on birth certificate, local marriage certificate or any in other ID's.

Yes, she has three names as 'First name'; to put in context how it looks as an example her first name is "Haleema Fatima Jabeen" and blank surname in passport and other documents. Some documents only has 'Full Name' which makes it simpler but everywhere else her Surname field is blank.

I don't have surname/family name in my passport.

It's very common for Asian families not to have surnames. Technically my father doesn't have a surname so had to use his first name as his surname back in the 60s when he came to the UK. it's not unusual :)

Husband's timeline - overstayer 11 yrs
08/16 - FLR (FP) Partner, refused 02/18, 03/18 - JR permission refused with merit
08/18 - FLR FP (Partner) PSC - Approved
07/20 - FLR FP to FLR M Switch - Approved, 03/23 FLR M Ext Approved.

If anything i've never heard of asians not to have a second name as culturally in a lot of regions that fathers or grandfathers names get inherited

I agree, my sister has a surname just for the sake of a field on passport, i.e., broke down her full name to appropriate names :)

We cannot leave the surname field blank in visa application, few options, which one would you recommend:
1. Copy First name into Surname and explain in supporting letter
2. Write 'N/A' in surname and explain in supporting letter
... Cant think of any more ideas

Thanks

I'd leave blank and explain that culturally not everyone has a surname in your region so you do not either. But make sure no other documents has two names as that can contradict this statement.

I have split and merged your surname questions with your existing tier 2 dependent topic.

Please do not tag onto old topics in the family immigration sub forum.
