Child tax credit and benefits

Post by Instantpot » Tue Nov 20, 2018 4:52 pm

Hi,
I have two kids, one was born in U.K. 2013 and the second born in the USA 2017. Both were born before I got my ILR in May 2018.
Can I claim child tax credit/benefits for my USA born child. My wife is still under immigration controls and both are currently still in US.

Yes. It is the parent that claims not the child. However, you can only claim for children who are in the UK.

Child benefit in your name only but you would need to mention your spouse as required in the form.

Child tax credits if you qualify, MUST be claimed in JOINT names with your spouse and both incomes will be taken into account to determine your eligibility.
