MN1 Application for child born in India.

Hi All,

Need advice, to confirm that my understanding and section for MN1 application for daughter's British Citizenship is correct and can go ahead with application.

Timelines:
1. Child born in India. July 2006.
2. Parents and Child got Indefinite Leave to Remain (ILR) together - July 2011.
3. Father Naturalised as British Citizen. Apr 2013.
4. Mother holds Indian Passport.

As I undestand, we should use MN1, most IMPORTANT,apply under Section 3(1)[Discretionary applications under section 3(1)].
In our daughter's case, Registration under section 3(1) will give British citizenship otherwise than by descent.

Documents required for registering a child as a British Citizen:
1. Completed MN1 application form with two referees and written consent from both parents
2. Proof child has indefinite leave to remain: Child's Indian passport.
3. Proof both parents have indefinite leave to remain: Father's British Passport. Mother's Indian Passport with ILR.
4. Proof the child has been living in the UK for the last two years (passports, travel documents and school/ college letters): School letter.
5. Full birth certificate and a translation
6. Passport or visa used to enter the UK (not essential): Child's 1st Indian passport with UK entry stamp.
7. Both parents passports - Evidence that one parent is British and the other has indefinite leave to remain: Father's British Passport. Mother's Indian Passport with ILR.
8. Parents Marriage certificate

Mother will eventually be getting Naturalised as British Citizen. I hope currently not having British Citizenship, still holding ILR will not negatively affect child's application. Please let me know, if you think, this should be addressed in any specific manner, or will it be safer to apply both Child and Mothers application together.

A child born abroad can apply for Citizenship when ONE parent is already British (or applying with child) AND the other parents holds ILR.

There is NO requirement that the mother must also apply for citizenship for the child to qualify.

Hi CR001,

In the form - MN1,Section 3 is confusing. When we apply under Section 3(1)[Discretionary applications under section 3(1)], none of the parents are British by descent. In the application, Section - 3 requires us to provide parent details who is a British citizen by descent and on whom this
application is based.
Can you please let me know, are we supposed to leave this section BLANK? if not, then whose details we should provide? Father is British Citizen by Naturalisation.

Ignore the sections that do not apply. Like section 3. Read the questions carefully.

The same form is used for a number of different routes of registration.

Thanks CR001. I re-read the MN1 guide, and it also says to ignore Section 3 of document if not applicable.

I feel more confident of completing MN1 form - offline. But I read, on local council website that Nationality Checking Service will be closed from 31st Dec 2018.
Does this mean, completing MN1 application is only option? Please guide.

You use the online form and can then choose to submit using the new sopra service for document check and Biometrics.

Hi CR001,

In the online application, how to leave Section 3, related to "Grandparents details" BLANK?

Anyone completed this before can kindly confirm?
If I select "I do not know these details", then it wont ask to complete Grandparents details. But this would be wrong answer isnt it?

If do not selct check box for "I do not know these details", then I can leave fields for Grandparents details BLANK. However, option "Relationship to you" e.g Parental Grandfather is Compulsary.
Also, question: Did they become a citizen of the United Kingdom and Colonies or British citizen by registration or naturalisation? Yes/No is Compulsary.

Answering these Compulsary questions and leaving Grandparents details like Name, Date of birth, Address, do not seem to go together. Can someone please suggest the right method?

When I am completing Online application, it is not specifying as Section 3. The "Grandparents details" section appears automatically. :cry:
