French national working and living in Berlin, marrying Indian in India

Hi there,

My partner and I are planning on getting married in the next couple of months and starting our lives together in Berlin where she currently lives. The plan is to get married in India and then fly back together.

From what I've discovered thus far, I (Indian) would require a Schengen Visa to allow me to enter the country, after which I would be able to apply for my residence card, which usually takes around 6 months to process.

To obtain a residence card, I will need:

- a valid passport
- my partner's registration certificate as an EU national or any other proof of your residence in the country
- proof of the family relationship- marriage certificate


During the processing time, I can work and am essentially entitled to the same right as any other EU national.


My questions are:

- will we face any issues having our marriage certificate recognized when I apply for my residence card in Berlin?

- Are there any steps I haven't mentioned/ should be aware of?

Also, on the Berlin.de website, under the prerequisites section for teh residence card, they ask for:

Right of freedom of movement applies
Family members only enjoy a right of residence derived from the EU/EEA citizen, if the latter enjoys the right to free movement, e.g. as
an employee
a self-employed person
a non-employed person

Is your partner an EU national and not German?

1) They might ask your Indian marriage certificate to be apostilled.
It would be very useful for you if your partner registered the marriage in France via the French embassy in wherever you are in India.

2) Check this page out. It explains you everything to get your residence permit in Berlin:

And yes, you can work straight away.

Only the issuing government can apostille the document.
Germans can't apostille Indian marriage certificate.

The benefit of registering the marriage in France is that your marriage is registered in EU.

The last bit you quoted means that not all EU nationals automatically benefits of right of free movement. They have to be outside their home country either working, or studying, or looking for work etc (i.e., exercising their right of freemovement).

Meaning: Your french partner simply being in Germany does not make you an EU national exercising her right of freemovement. However if she is working in Germany, then it means she is exercising her right, thus you can benfit from the article 2004/38/EC.
