Apply for ILR during C3 Leave

Post by Davod 10 » Thu Jan 17, 2019 4:19 pm

Hello,

I'm writing this post to find out if I still would be eligible for ILR if I reach my 10-year lawful residence with a C3 leave at the end.

I have been in the UK since July 2009. I entered with a student visa (tier 4) and since then I have been renewing my leave based on the same category (from GSCE to masters).

My current leave expires on the 04/05/2018. This means I only need less than 2 months of visa before I would be eligible for ILR based on a 10 years lawful residence in the UK.

Now, my question is, before my current visa expires, if I make a random application (please don't judge me for saying this) and reach to 10 years lawful residence while a decision is being made for my application (being on C3 leave), would I still be eligible for ILR?

all of these basically means, being in the UK for 10 years and in the last 2 months I would be on C3 leave would this situation render me eligible for ILR?

Thank you for your help
