SET O Dependant Co-habitation proof

Post by shin25 » Mon Jan 21, 2019 7:06 pm

Hello Gurus,

I am going to apply for my wife's ILR (SET-O) and wanted to quickly check is co-habitation still a requirement?

Wife -
First Tier 1 Dependant - 28/11/12 to 03/05/14 (First entry - 16/12/2012)[
First extension - 01-04-2014 to 01-04-2017
Current extension - 18-02-2017 to 01-04-2020

ME -
ILR - 15/02/2013
Citizenship - 12/11/14 - 12/11/24

Planning to send the following documents, please could we confirm if that's sufficient?

Co-habitation proof
  • Council tax 2 yrs bills
    Joint Bank statements

marriage certificate
Life in UK test
NARIC Statement of comparibility (degree compared to British bachelor degree)
NARIC english language assessment (degree meets CEFR level c1)

Optional documents (as suggested by an expert in this forum in relation to a another question)
My bank statments
My Salary slips 11 months (Feb 2018-Jan 2019) (Jan salary still not credited) (mine)
My Dividend voucher (Feb 2018 - Jan 2019)
Letter from accountant confirming my earnings for period (Feb 2018 - Jan 2019)

is there anything else I need to submit or is this enough?

Hello Gurus,

I am going to apply for my wife's ILR (SET-O) and wanted to quickly check is co-habitation still a requirement? yes as you have to show a subsisting relationship

Wife -
First Tier 1 Dependant - 28/11/12 to 03/05/14 (First entry - 16/12/2012)[
First extension - 01-04-2014 to 01-04-2017

Any reason you did not apply for her ILR before as she seems to be eligible for quite some time now?

ME -
ILR - 15/02/2013

  • Council tax 2 yrs bills
    Joint Bank statements

marriage certificate
Life in UK test
NARIC Statement of comparibility (degree compared to British bachelor degree)
NARIC english language assessment (degree meets CEFR level c1) She needs equivalent of Level B1

Optional documents (as suggested by an expert in this forum in relation to a another question) I dont think you need to send whole years if you wanna include you can include 3 months payslips or bank statements

Sample what moderator Marcnath used at his time for cohabitation:
“Co-habitation evidence

Documents included:

1. UK Visa and Immigration letter, ___ 2015 – 2 No
2. Council Tax bill – Feb 2016
3. Lease agreement – Feb 2016
4. Council Tax bill – March 2016

Thanks very much for a very quick reply, much appreciated..

I got delayed initially I thought that absences does effect her status (not that she has been out for very long but there was once a 3 month long holiday I only came to know at a later date that Set-O dependant absences are not calculated , and when I tried to get an appointment for premium service centre for the last 5 months was never able to!
NARIC english language assessment (degree meets CEFR level c1) She needs equivalent of Level B1
I believe this should be okay? Please confirm, basing on my assumption that C1 is greater than B1 ?

Optional documents (as suggested by an expert in this forum in relation to a another question)
I dont think you need to send whole years if you wanna include you can include 3 months payslips or bank statements
My bank statments
This is because i am a contractor and have taken dividends in March and Nov, I work with low salary and high divident so thought of putting all the 11 months in there so that the proper gross salary shows up.

“Co-habitation evidence
how many do we need? Is there a minimum number ? Can i just add Council tax bills and my Joint bank statmeents? My wifes name is not on all the utility statements.

Please could you also confirm if my list of documents is sufficient?

Thank a lot CR001 .. I havent added my wife's name in Tv License, never realised it would be that important. Will try to add NHS letters which is on my wife's name.

Can I please ask as a final question is all the list of my documents okay or is there anything else I need to add for SET(o) dependant visa? Actually I had completely forgotten about co-hab proof and only realized when browsing through this forum, so just wanted to see if there is nothing else that I have missed?

hi Zimba,

Thanks a lot for your reply, not sure why my question didnt come as a different post altogether :)
I will be printing out these bank statements from the same online pdf I have downloaded from the site? Is that necessary? What actually happens in super preimum appointment? Do they cross check all the documents?

SET O Dependant - English language assessment

Post by shin25 » Mon Feb 04, 2019 9:40 pm

Hi,

I have an appointment super priority @croydon for my wifes ILR (SET O) and was cross checking my documents -
1) In the sticky post here it mentions about NARIC VisaAnd Nationality service. Is that essential to use that service as I have got NARIC Statement of compariblity and English language assessment i.e the degree taught is at level C1 ? is that sufficient for ENglish language assesment proof for SET O?

2) Co-hab -- Is 6 set of documents required? I dont have enough joint names for those? I am planning to add Council tax, Bank statements, Water bill, may be driving license . Will that be sufficient?

Hi,
Can someone please reply on this post? I am unable to create a new post and am assuming putting this post back to the old thread wont get any visibility for anyone to reply as it would be assumed answered?
I have my appointment this week and would really appreciate if gurus could respond to both my question?

Much appreciated..

Cheers,

HI CR001,

As always its very reassuring when you confirm any of these. I only got confused because on a sticky note (indefinite-leave-to-remain/faqs-english ... 93792.html) in this "Indefinte Leave To Remain" board one of the question replied by the moderator was that it will be better to explicitly confirm from UKV&I beforehand if they still accept ELA/SOC after the launch of V&NS service.

As long as you confirm its okay I would be more than happy to give my mind some rest! :)
Q8: I will be applying for settlement after 06-Apr-2016. Can I still use ELA / SOC ordered before 06-Apr-2016 from NARIC in my application?

There is no announcement from UKV&I whether the following combination of documents are still being accepted in support of a settlement application.
An English language Assessment (ELA) from UK NARIC, or
A Statement of Comparability (SoC) from UK NARIC confirming your qualification is comparable to a UK degree and an official letter from your university with your name, the title of the degree, and that the qualification was taught in English.
If you wish to use ELA / SOC statements obtained before the new V&NS service was launched in a settlement application to be submitted after 06-Apr-2016, please check with UKV&I beforehand (preferably in writing, by enquiring through email).
