What docs req for BC app through Spouse ILR based?

Post by Ilrsetm » Sat Jan 19, 2019 9:34 am

Hi there,
I have been granted my ILR through Set(M) and i know i can apply straight away for my Bristish Citizenship but bit confused regarding documents to submit i saw a few comments by CR001 he said don’t repeat the ILR application requirement documents which i agree with him as BC is not comes under the immigration law its totally different and comes under the nationality law so it means we don’t need to submit a lots of documents as did in for ILR.
Anyone could please let us know the required documents for BC Application based on Set(M) ILR.
Thank you

Have you reviewed the guidance?
https://www.gov.uk/government/publicati ... en-form-an
It explains what is needed.
There is only one type of BC application.

Do you have a rough idea mth/year and input that? It's not critical and you could say not known (UKVI asks for the details just in case you might already be a BV based on your parents details).

Thanks you

You are ok to give the best estimate of the DOB. This isn't critical - UKVI asks for the details just in case you are already a BC through your parents.

Quote from the requirements:
1.24 - 1.31 You might already be a British citizen without realising it. To decide
whether you already have British citizenship by descent we need details about your
parents.

You are no it British yet. Suggest ask your passport application forms when ready to apply.

The guidance notes that come with the passport form clearly states what documents must be sent. Have you looked at the form and notes?

Marriage cert not required.

Have you worked at any time when you were not legally allowed to? Does the income that you have declared to the Home Office match the income that you have declared to HMRC, etc? Essentially, have you broken any employment/tax/immigration laws in the past ten years.
I am not a lawyer or immigration advisor. My statements/comments do not constitute legal advice. E&OE. Please do not PM me for advice.

Hi secret.simon, thank you for your reply.
No i have never worked illegally during when i was on my study visa as was allowed to do work 20 hrs a week and then i had swtiched to Spouse visa.
You said income have declared to Homeoffice should match to hmrc records which is a bit make confusing what income i have declared to Homeoffice when? Could you please explain this in simple words.?As for two extensions of spouse visas i have declared as financial threshold of £18,600 more than this and also again have proved when had applied to ILR Set(M) over £18,600 together with my spouse were nearly £46K so you means to match that income or what?
I can put the employment histroy since 2011 as i had got enter to leave that year should it be ok.
Cr001 said don’t need to submit the P60s or payslips again to repeat the ILR process again is it right?
I personally hes right cos its not the citizenship requirement.
Your comments please
Thanks

Does tax arears could affect my BC Application?

Post by Ilrsetm » Sat Feb 02, 2019 4:54 pm

Hi there,
I was working part time only on weekends in 2006 and my boss was dogy as wasn’t giving me my payslip and i did may times but anyway then i left the job with him and then after a year or so HMRC sent me letter that i owed the tax so i was so surprised and did get stress but i had phoned to tax office and agreed with their offer to resolve that issue to repay in full or in instalments so they changed my tax code from 1150L to 844L and they said will take that money from your weekly wages.
Should i disclose this into the cover letter if the CW sees it on my employment history but not sure they can get know that it has been solved b/w and tax office and getting back that money from my wages and the prove is only with me is changing of my tax code nothing else that was over the phone.
I haven’t received any letter from tax office of confirmation of this but still getting that owed tax money from my weekly wages as they changed my tax code.
My appointment is on 11th feb at sopra steria please need your urgent expert advise.
Thank you
