Husband recieved call from HO - 31st oct asking regarding employment
1st escalation -10 dec 2018
Response from home office -17 dec 2018 said cannot give time scale
MP involved -7th jan 2019
Letter recieved from MP saying cant give timescale and escalated as urgent on 28th jan 2019
21st jan 2019 got standard email stating case not straightforward

I had the worst news last night when I checked my online banking to find that I had been refunded the IHS charge in full :shock: I know this surly means that the application has been refused :cry: and due to my wife opting to have the passport delivered to her by courier I am still unaware of what the reason for refusal is

Yes, this likely is a refusal and highly likely due to your financial requirement not being met if you applied based on salaried basis and not the non salaried basis as you were advised to.

Your employer letter stating you earn a basic salary below the HO threshold doesn't help either.

I did not apply based on salaried basis. My solicitor worked out the calculations via the non salaried basis and sent a cover letter along with the application with his calculations. I also showed cash savings which would have made up for some of the remaining short fall. I only proceeded with the application as I was told by an Immigration Solicitor that he could not see a reason why my application would be refused. Clearly he was wrong and yes I agree if there is anything that would have refused my application then I also do feel it has something to do with the financial requirement but I need to wait for confirmation.

If you check my last post on that topic you can see that I asked a question and no one responded to it so I took it from there that the post was dead. Also I am not duplicating anything as my post is about a decision that has been made and not about me asking for guidance prior to my application. You can also see that I have bee posting on this topic about waiting for a decision and have now gave an update on the outcome.

Read my response again, carefully, and tell me where I said you ARE duplicating!!!

Merely stating members will ask questions and you will end up DUPLICATING what you have already posted previously. Members should not continue posting in this topic once a visa is refused for this very reason!!!

I did not apply based on salaried basis. My solicitor worked out the calculations via the non salaried basis and sent a cover letter along with the application with his calculations. I also showed cash savings which would have made up for some of the remaining short fall. I only proceeded with the application as I was told by an Immigration Solicitor that he could not see a reason why my application would be refused. Clearly he was wrong and yes I agree if there is anything that would have refused my application then I also do feel it has something to do with the financial requirement but I need to wait for confirmation.

If you check my last post on that topic you can see that I asked a question and no one responded to it so I took it from there that the post was dead. Also I am not duplicating anything as my post is about a decision that has been made and not about me asking for guidance prior to my application. Hi I applied from Pakistan for husband. Well before we start UK Visa we had started a Ireland Visa which took 1 year but got no response from then so we withdrew it and we have an email stating we withdrew it. And when we applied for UK Visa there was a question asking if he had been refused any Visa including UK. We said no because as far as we knew we hadn't. And home office said that he had been refused Ireland Visa. They showed us a date where they said he had been refused visa. But 5 days before that date we emailed Ireland saying we want to withdraw our application because we wanted to start UK visa. And 5 days after email we got our passport back for husband
So now I'm confused we answered the question honestly as this is how we saw it. Now we think if we appeal it and show them the email that we sent they my reconsider there decision and maybe overturn it but I don't know yet. I don't want to start a new application because it my just take another year for them to make a decision like this one did. So rather appeal it as we r not in wrong. And also we have a disabled daughter who misses her dad dearly so we will mention her illness in it too. Explaining how she has a heart problem and needs her dad by her side. Now u tell me were we wrong ?

Yes, this likely is a refusal and highly likely due to your financial requirement not being met if you applied based on salaried basis and not the non salaried basis as you were advised to.

Ok i have read that thread

Contrary to what anyone else says, your letter of employment must include your gross annual income. Its standard.

I do not agree with CR001 on this occasion sadly
