Tier 2 Visa: Admin Review

Hi,

I applied for an in-country Tier 2 Visa on 27th December 2018. On 5th Jan 2019 my visa got refused because of an error on my part: as a new entrant you can apply for a visa of max. 3 years however, i did not know that and I applied for 5 years so the home office considered me as an experienced worker and refused my visa as my salary did not meet the minimum requirements for an experienced worker.

I was able to apply for an admin review where I explained my mistake. I applied for this admin review on 7th January 2019. Its been 3 weeks and I have not heard anything. Their deadline to respond to me is 4th February 2019 (28 calendar-day response period).

Does anyone have any previous experience in this situation? Is it normal for them to take this long?

AR will fail. Admin Review is for when HO has made an error not the applicant.

You need a new CoS and have to apply again.

Yes. They have 28 days to respond and sometimes it can take longer than that.

Not sure why you opted for AR when HO made no error in refusing the application.

Hi,

My admin review was a success with my application being sent back to the original caseworker. My question is how long will the case worker now take to revert back with a new decision? Also, my current visa expires on 19th Feb 2019. Am I entitled to stay in the UK until I hear back from the caseworker?

Hi,

It's been 8 weeks since my application was sent back to the original caseworker after a successful admin review and I haven't had any update. I wrote a letter to UKVI with no avail. Similarly, calls to the contact centre were met with 'no service standard for your situation' or 'i don't know'.

Can someone advise me regarding potential next steps?

Hi,

1. Online Application Made: 20th December 2018 to switch from Tier 4 Student visa to Tier 2 General Work visa.

2. Biometrics Submission and Documents Check: 27th December 2018; Applied for 10-day Priority Service.

3. Visa Refused: 3rd Jan 2019

4. Submitted for Administrative Review: 7thJanuary 2019.

5. Successful Administrative Review: 6thFebruary 2019.

Upon the success of the administrative review, the original refusal was withdrawn, and the administrative review team sent my application back to the original case working team for a reconsideration.

It is has been eight weeks since 6th February 2019 and I have not had any further update regarding my application.

I have written them a letter for an update and received no response. Contacted the called the contact centre multiple times for a timescale which no one could give me.

Please don't comment without knowing what is UK VI and what is administrative review!!!!.. after success of administrative review ,we can message UK VI to speed up visa processing

Who do you think does the Admin Review??? It is done by UKVI, not some random third party.

Don't assume members are ignorant and I suggest you read the forum rules, as you were required when you joined the forum, particularly about tagging onto other members threads.
