10 Year ILR different visas- Two different EU sponsors

Post by MariaM12 » Thu Feb 14, 2019 12:42 pm

Hi all,

I hope I can find some answers here.

Can I apply for an ILR as I have been in the UK for 10 years soon 11?

09/04/08 to 30/04/09 student visa
23/03/09 to 31/05/10 Student visa
11/05/10 to 11/05/11 Studen visa
03/05/11 to 20/04/14 Studen visa
03/03/14 to 03/04/19 Unmarried partners visa to a European, then we broke up and I got married to other European and got a new visa.
22/01/2019 to 22/01/2024. Family member resident - EU.

As I have not contact with my ex partner I can't proof that he was working during the time that he sponsored me, I have his national insurance number. I know that he has been working i the UK without gaps.

Regards,

Maria

You need evidence from both EU partners of proof of their residence and exercising treaty rights for the WHOLE period you are claiming under the EU route towards ILR based on long residence.
03/03/14 to 03/04/19 Unmarried partners visa to a European, then we broke up and I got married to other European and got a new visa.
22/01/2019 to 22/01/2024. Family member resident - EU.
What date did you break up with your unmarried partner and what date did you marry the new EU partner??

Your rights under the EU rules ended when you broke up with your unmarried partner.

So until you got married to someone else, you would likely be viewed as an overstayer.

IF I apply for ILR and it is rejected, will I still keep my FM of EU visa?

A refusal, which is highly likely, won't affect your current visa/RC. You will lose the substantial application fee though.
