ILR PBS dependant

Hi,

I was going through the guidelines for counting continuous period for ILR. Can someone explain this:

PBS Dependants:
You must not include any absence from the UK during periods of leave granted under the Rules in place before 11 January 2018 towards the 180 days allowable absences. For example, if a dependant’s qualifying period includes initial leave
granted from 1 January 2015 to 31 December 2017, and an extension granted from 1 January 2018 to 31 December 2019, you must not count any absences before 1 January 2018.

I am a Tier 2 dependant (granted Nov 2014). I am doing my Phd in Ireland and after 2015 (finishing my coursework etc) I have ensured my absence in UK was not more than 180 days. Does the above mean I do not have to show proof of my absences before 2018? If so it would be a great help as collecting all my tickets and boarding passes is a lot.

Would appreciate if someone can explain the above.

There is NO absence limit for time and visas issued before 11th January 2018.

Thank you for your reply. Does this limit apply for first grant of Tier 2 or extension.

Below are my Tier 2 details:

Tier 2 (first) - 10 Sept 2014 [Entry to uk 17 Sept 2014]
Tier 2 (husband changed employer) - 14 Nov 2014
Tier 2 extension - 14 Nov 2017

After what point do I need to show my travel history (if at all) and give proof of less than 180 day absence?

You ONLY have to list absences IF your most recent/current visa was ISSUED on or AFTER 11th January 2018. Any absence on visas issued BEFORE this date are not relevant and no proof or anything required.

Dear CR001,

Thank you so much for your reply.

This has saved me from the immense amount of work of getting my travel history together. I travelled almost every week during my term to Ireland and it is a big relief to know I do not have to account for each missing stamp on my entry back to UK.

I really appreciate your help and guidance.
