Hi Rob,

I had serious concerns about the practicalities of the scheme. and I stand by all my previous comments. I Was right about all my predictions as far as I understand the matter. I will post a full update on Monday or Tuesday on. what I can say at the moment is that is it is a catch 22 situation for those with over 5 years in the U.K but less than 5 years under a RC or EU passport.

here is the latest up date on the scheme from the HO addressed to the House of commons/ House of Parliament.

at the moment the H.O is processing about 20,000 cases a week. so about 1 million a year. with 21% of the case without decision. still a 3.4 years to process all. but achievable. specially if the H.O improves it capacity.

Both me (non-EU) and my wife (EU citizen) applied for EU settlement scheme yesterday 17/02/19 around 6:30 pm. Today we both got our settled approval letter just before 9:00am this morning. I applied with my pr card and wife with passport, no other evidence. Quite quick and straight forward.

Anyone in a similar position (non-EU family member, holder of biometric RC) has had any confirmation of status, or know how long this takes after their EU family member has had theirs?

It's bit annoying! They didn't give atime frame either. Most of the cases outcome was very fast

It is a bit annoying, but... there is absolutely no urgency.

I'm still having some hope that if it's taking so long it's because it's not a straightforward Pre-settled case, and that I could be granted Settled status (although that is not what the experience of other cases tells us).

Just thinking how silly it is that they have simply not thought this through with clear guidelines to deal with non-EU with over 5 years in different visas, as to have to escalate our cases. It's clearly a trend, I know of at least 5 people who have waited substantially more than most applications, and its always that same profile.

What I believe is our cases are straight forward if they start counting from the day of issuing UKRC!

When someone is living here for more than 5 years and system offered them pre-settled status but when they provide more evidence of living then case worker Grant it as settled status. Same should have been implemented to our case as well! Though system offer us settled status but evidence says Pre settled it should go this way

I am a non eu husband. Me and my Eu wife just applied last night as she is here since 08/2014
So she selected pre settle status I have selected settled status as I am here since 2011 they could not locate my hmrc record automatically so I had to provide my bank statement as resident evidence and marriage certificate as a approval of relationship! I have applied with my RC (Not PR) which issued in December 2015.. I am afraid I will get pre settle status too????? I have got my COA straight away.

I have the impression your choice of words is misleading. For the sake of clarity and to avoid confusion to everyone else, can you please confirm that what you mean by "she selected pre settle status" is actually "she was informed she would be considered for Pre-Settled Status" and what you mean by "I have selected settled status" is actually "I was informed I would be considered for Settled Status".

As far as I know, the applicant does not "select" which of Pre-Settled or Settled status they are applying to. It's the application that decides, based on NINO history, and it's important people that have not applied don't assume they have to make the choice.

based on your RC history, yes, you should be granted Pre-Settled status, just as I should be granted Pre-Settled status (over 9 years in UK but only 3 on RC), whether we like this or not, and regardless of what he hope for, unfortunately :(

You have the option to select what you are applying for, settled status or pre-settled status.

Well my wife is here since August 2014 so not five years yet.. during the application we have selected pre settled status...and she got it next day on 19/02/2019 though I am still waiting it seems I am going to wait a lot!!!
I was not aware of how to calculate continuos 5 years as HO does not have clear process for non Eu family members so I thought i can include my previous visa catagories as continuous years!!!

Let see what their answer would be? It’s been third day I am waiting for.. anyone in same situation?

Based on your answers and HMRC history system will recognise how long have you been here and will offer Pre-settled status or settled one.

Are you talking from experience? When I applied on January 21st at no point did it let me choose, it just informed me the application would be submitted for Settled Status.

Well if you read our posts you would know non-EU with over 5 years in UK are waiting on average between 3 weeks and two months.

hi

We applied yesterday - 5 of us:
  • EEA National, and
  • 4 Family members


We all hold either DCPR or PR Cards. Within the span of 3 hours four of us got settled status confirmed. However for one of the kids no response at all. Application submitted, we got the COA and nothing since.

This probably means nothing but I am a bit concerned, I just hope his application hadn't gone missing as the system is still on trail ...

Should I chase them already? Has anyone seen a similar processing pattern?
