Hello All,

I've been reading through hundreds of posts in this forum silently, which can reduce some stress coming out while waiting. I just wanted to add my timeline here so as to add a datapoint :D

Visa Type: Tier 4 General to Tier 2 General, Super Priority, no dependents
Date of Online Application: 18 Jan 14PM
Date of Biometrics: 28 Jan 9AM at London Croydon – around 10AM after biometric taken + passport pages scanned. I think the UKVCAS service was good.
Date of Email Decision: 06 Feb 12PM
(Gosh! 7 Working Days after biometrics! This came right after my MP's email reply and my 1st-class "large letter" arrival at UKVI, The Capital Building, New Hall Place, Liverpool, L3 9PP)
Date of Decision Letter: 08 Feb 10AM (showing decision made on 06 Feb)
Date of BRP Delivery: 22 Feb 3PM with my 1st NINO number (my ID wasn't checked by DX...)

On 12 Feb I asked the status of my BRP to 'BRPDelivery@homeoffice.gsi.gov.uk', surprisingly they replied me on 15 Feb that there was a delay on BRP production because they were waiting for the Department of Works & Pensions to confirm National Insurance number (quite an interesting ‘newly aligned’ system ha…). I also wrote a complaint to 'complaints@homeoffice.gov.uk' for the delay of visa decision, but no replies or refund received yet. I may write a letter and post to the complaints team in early March.

I think that both contacting local MP and posting something to "UKVI in Liverpool" might work better than calling or emailing to UKVI. Good luck to everyone!

Applied for ILR Route : Set (0) - Tier 2 General (Super Priority)
Date application submitted (online) : 18-jan-2019
Date Biometrics Enrolled : 6-feb-2019
Approval Received : 8-feb-2019 (email)
Decision Letter received : 12-feb-2019
BRP Card Received : 22-feb-2019

Delay in BRP was purely cause DX "apparently" tried to deliver but no one was home...but they didn't leave a card and sent a letter yesterday.

Hi guys,

Reading the posts on this thread has really helped as I'm anxiously waiting for the outcome of my Tier 2 (General) Visa application (Extension of Tier 2 from inside the UK). Thanks all for sharing your experiences and it really seems to be so inconsistent!

Application made: 13/02
Appointment at Croydon: 16/02

Lady who processed my documents in Croydon said that I should expect a decision on Monday/Tuesday (18th or 19th). Haven't received anything to date.

Tried ringing the UKVI call centre and once I was put through to someone and she asked 'How can I help' - then hung up as I was talking! Bit ridiculous!

Hi CR,

I've been on Tier 4 for 6 years and Tier 2 for 4 years. First entry into the UK on 6th Jan 2009. I now have a Tier 2 BRP valid till Nov with my current employer, however I've been looking to change jobs and got the offer letter which is valid for a week last Thursday. I did assume the super priority will take 1 week max, which unfortunately doesn't seem to be the case for many of us.

I escalated through the phone today and the guy did say they will get back to me within a day or two even though the normal time they advise is 5 working days.

Hopefully the above helped with details. Any recommended ways that may "expedite" the decision?

You could have applied in December already, 28 days before the 10th anniversary of your date of entry to the UK.

You also cannot change jobs until you have ilr and your brp card. While you wait, your existing visa conditions continue and you can only work for your tier 2 sponsor.

So received my letter today and application was refused for ilr 5 yr route because i applied too early

I applied online: 31st dec
Biometrics: 14th of jan
Visa expired: 4th of Feb

Even though i called the HO and they said the date used is the biometric date on my letter they said it was the online date according to my refusal letter.

They have said I qualifiy under the 10year route and I should pay 500pounds Ihs

Did anyone apply early on the same route as me and it was granted?

I want to appeal this as it is total BS

Ilr 5 yrs route
They said I have completed only 58 months based on the date of my online application

I first entered as a Tier 4 student in Aug 2010 so I have been in the uk since then.

Got married in Feb2014 and applied for leave to remain on the 19th of Feb 2014

Hi konzo,

I would have been eligible on the 8th of Jan, counting by the 28days rule before my visa expired on the 4th of Feb

However, biometric was done on the 14th of Jan 19

But according to the HO letter my application date was the 31st dec 18 when I submitted online

You should have submitted your biometric on Tuesday, 22 January 2019 if ur spouse visa was issued on 19th of Feb 2014 and not 14 of January 2019. Your permit has already expired. So u have no move to the 10year. However if u have been living in the UK lawfully since 2010 then u may be able to apply on the 10years lawful residence in 2020

What date was your first spousal visa issued ? The date your visa expires is not important here. For spousal visa it's the date it was issued and if out side the uk, it's the date u enter the UK

I recived my application letter and it’s refused saying that;

1) It is noted that your current leave to remain in the UK is as a Tier 2 Migrant, however your most recent grant of entry clearance was under the rules in place after 06 April 2010. Therefor your application is refused under paragraph 245GF(d).

2) Although you have supplied a certificate showing you have passed an IELTS test, these tests do not appear in appendix O of the immigration Ruels you therefor fail to meet the requirements of paragraph 245GF(g).

They also advised me that I can go for Administrative review if I want.

I am really asking for any advise from anyone of you for what shall I do now ? Your advise is highly appreciated?

You should have submitted your biometric on Tuesday, 22 January 2019 if ur spouse visa was issued on 19th of Feb 2014 and not 14 of January 2019. Your permit has already expired. I dont think that would have made a difference because the letter started online application date and not biometics date.

Applying on the 22nd of jan = 59months 4days
4th of feb = 59 months 17days

So techincally it was impossible to do 60 months unless i waited for my visa to expire n applied in mid feb

The requirements is to fullfill 60 months period but if u apply 28 days before 60 months it's count as a 60 months. thats why u should not apply before 22 nd of January. Ur visa is shorter than 19 Feb 2019 because I feel u applied same day service when extended ur visa at 2016.flr m always count the starting date not expiry date.

Contact with a good solicitor may be u can fresh apply set m within 14 days of refusal. If you can than u have good chance to get visa.i m not sure about u have any chance in apeal.also u can check the 60 months requirements on ukba website.

I’ve heard a person apply on Saturday after our appointment and got an email on a Sunday. I didn’t know they are working days for caseworkers.

Our case should be straight forward and her previous spouse visa renewal was granted 2.5 years ago without any issues.

Fingers crossed and will update you all if we get an answer.

Update:

15th Feb: Escalated via phone and received the generic “allow 24 hours” email.

15 Feb: Spoke with my local MP and they were willing to take a look at it for me.

18th Feb: MP emailed me saying they are asking for details on my behalf.

22nd Feb: 2nd Escalation via phone (they already had my wife’s details from the mobile I called from, no need to give details). No generic email received but did get an email from HO saying they are “still considering my application” email and it will take up to “6months”.

I heard they send this generic email monthly and we did apply online exactly on 22nd Jan..

Has anyone else got this email if their application has been submitted for a month or more?
