Help! Home Office letter! How come they say "Outside rules"?

Post by luannacool » Fri Feb 22, 2019 1:15 pm

I applied to extend my spouse visa after the first 2,5 years leave. It was supposed to be a very straightforward application. We have a daughter together, finances as required, english certificate, etc.

Today I've received a letter from home office and at first I thought it was a normal acknowledgement letter, but at the end it reads:

" Your application raises issues relating to the European Convention on human rights... As such it falls outside our normal service standards for deciding leave to remain applications. [...] You have requested leave to remain outside the Immigration Rules which are complex in nature. As such it falls outside our normal service standards for deciding leave to remain applications."

How it comes is "outside the immigration rules"?
Anyone had the same and it went smooth as it should?

Are you sure you completed FLR(M) and not FLR(FP)??

And also, if FLR(M), are you sure you did not tick the below if it was asked on the form??
on a 10-year route based on your family life as a partner, parent or dependant child or based on your private life in the UK – Form FLR(M)
Char (CR001 not Casa)

It was the online form, they lead you to the application.

I am sure it was the right one, and it is everything online now, no chance to do it wrong.

We don't all have sight of the online forms, but surely you must have the link of where and what you applied for given that there are many different forms for different routes and mistakes can very easily be made?

Have to wait and see what they are going to send me next. One more week for the 8weeks deadline, in the letter states if they need more time they will write me again.

Thank you for your reply

Maybe if you write the whole contents of acknowledgement letter then it might be more helpful.

Did you save or print a copy of the completed form?

Is the form still available when you log in to your UKVCAS account?

Well when you initiate the application based on your circumstances, it will lead you to FLR(M) .

It appears that it is FLR(FP) you applied for, and that takes more than 8 weeks.

Yes, the copy of my form still online.
When starting the application, based on the circunstances you answer it leads you to the FLR(M) I don't know how my answers could have let me to the FLR(FP) form.

On my wife’s online application for her first FLR(M) extension following entry on 2.5 year spouse visa, I have selected options per the photo.

Is your option selected the same?

If so, perhaps the template letter you have been sent has been done in error?

I cannot see the photo but I selected "current in the uk, no other application, basis of application: partner of British citizen, current visa: british partner, leave granted BEFORE 2012 - No, immigration adviser-No" after that you can make a log in and start the application.

I guess you have correctly applied for FLRM but just confusing from the standard template of the letter.

As another check, log into your Gov.uk application and download the 'supporting documents checklist'. On the last page of my wife's checklist it states:

You should receive a decision on your application within 8 weeks of your biometrics appointment. We will contact you if it will take longer to process your application.

This might confirm further you have applied for FLR(M) (which is typically 8 weeks) but they've sent you the wrong letter template.

Even if you applied for FLR(M), if the evidence you provided does not show you meet the financial requirement or the requirements of Appendix FM-SE, then the law empowers the HOme office to consider your case under FLR(FP) and appendix EX 1. So it may be worth examining the evidence you provided.

All checked. Its either they have sent the wrong template.or overlooked our evidence because we meet all the requirements. I hope is the first option.

Congratulations.
So seems they did sent you the wrong template when in fact they intended to advise they may not meet their usual 8 week timeframe.

Yes, that is a big problem, they make people stress out for no real reason.
