If your question is in relation to completing the details in the form, I suggest you complete it as honestly as you can as HO can and do cross check.

Hi Cr001...do u have any information as to when home office start working on an application after receiving all supporting documents and biometric enrollment?

They only communicate if they need extra documents from you. If its approved, you just get a letter in the post in a brown envelope. Will take 4-6 weeks atleast.

Hello moderators.
I submitted my online application on 21 Feb 2019. I was on holidays from feb 2014 till May 2014 so does this mean I do not meet the residence requirements?

So you will fail to meet the requirement of 'physically present in the UK at the start of the qualifying period', ie 20th/21st February 2014. This will likely end up being a refused application as the physically present requirement is mandatory.

Is your spouse British??

I thought that one needed to be present in UK for 5 years from when he first entered this country. I think I should just wait for my application refusal rather than approval :(

There are a few requirements that are mandatory :

1. ILR must be held for the full 12 months if not married to a British citizen.

2. You must have 5 years residence, which must include 12 months on ILR.

3. You must have been present in the UK 5 years ago (start of the qualifying period) on the same date you submit and pay for your online application now. So if you were away/out of the UK on holiday on 21st February 2014, you fail to meet this requirement.

HO don't ban you from applying again!!!

You simply reapply and pay the fees again when you qualify, ie after the 1st of May 2019 (note the fees will have gone up by then too).

These are my timelines

First entered UK: Nov 2011 (tier 1 dependent)
Applied for extension: Feb 2013 (tier 1 dependent)
Applied for ilr: March 2016
Ilr granted: August 2017
Citizenship application: 21st Feb 2019

In all these years, from the date my of entry till today there are 125 absences in total.

The user means why did you not apply sooner and ask your questions before you applied to avoid the situation you now find yourself in.

The HO information clearly states the requirement to be physical present.

I just missed that info where it says u need to be physically present. I know I have made a big mistake. Just want my refusal as soon as possible.

Amina02, from the details you provide it seems that you qualified for naturalisation in August 2018, but you did not apply until 21 February 2019. Assuming this is true and all other aspects of your application are approved, the Hong Office may write to you to ask you to "re-declare" your application for a date when you were physically present in the UK, i.e. in January 2014. This is a type of discretion available to them. Here is a quote from the Nationality Policy :-

"Where the applicant fails to meet the requirement to be in the UK at the start of the qualifying period by 2 months or less, either side of the application date, you must consider using discretion to allow them to re-declare their application. Where discretion is being exercised you must request that the applicant re-declares their application, by using Doc Gen letter 4746."

Please note the words "consider using discretion." They do not automatically have to do this.

I advise you to urgently write a letter to UKVI explaining and apologising for your mistake and humbly requesting that they use their discretion in your case. Include all details of your application, such as:- name, date of birth, UKVI case number, contact details.

Just to add, I had a similar problem (omitted some information) and I suspected that my application would be refused. I used my initiative to write to UKVI before they made a decision on my application. Two days after receiving my letter my application was approved. :D

Thanks for your reply John. Yes I was eligible to apply for naturalization in August 2018 but couldn't do so because I couldn't afford the fees. I saved up money for a couple of months and then applied. I will write a letter to Ukvi as you have said and tell them my situation. If in case they do consider it what exactly should the date be written as this is bit confusing?
