I am in the process of applying for an ILR (Tier 2 General, 5 year route) for myself and my family and I stumbled across a section while filling up the online form for my spouse for which I require some advice. I would really appreciate it if someone can help me out.
My spouse arrived in the UK on 15/01/2014. The latest leave to remain was granted on the 10th of Jan, 2019. She has now completed 5 years of stay and hence eligible for ILR.
I understand that any absences from UK prior to Jan 11, 2018 can be ignored, so no problems there. My spouse also undertook a trip between the 3rd of March, 2018 and 14th of May, 2018 (71 days). This brings me to the following 2 questions in the set(O) form.
Does the period of stay on which this application was based include any leave granted since 11 January 2018?
-> I believe the answer here should be YES as the 5 year period includes the duration of stay covered by the visa issued on 10/01/2019.
Have you had any absences from the UK during any leave granted since 11 January 2018?
-> This is where I am truly stumped. Does the above question refer to any absences post 11/01/2018 or only those absences since 10/01/2019, i.e. the last leave granted since the 11 Jan 2018 rules came into play?
