I applied for RoR , and attached my x spouse passport and now she want passport back , can anyone please help how can I request them to return the documents, is there any form or online service....?

3)berchuz : Yes its normal, even on mine its written same, as you were married with EU for 3 years you will be considered EU family member for your entire life, now as soon as you complete 5yrs from the date of marriage apply for PR its straight forward and easy. :P

Good afternoon

You do not need to apply for PR card as it is pointless. All these residence/permanent residence cards will not be valid after 2020. Once settlement is fully opened after 30th March just apply for settled/ presettled status based on your current residence card (ROR). I may be wrong but you have already was issued with the residency card for 5 years so you just cannot apply for permanent residence card as you did not compete full 5 years of residency based on your retained rights to live in UK as a family member.

First of all ,
I’m very thankful for this forum and particularly OBIE if I can mention which helped a lot for all my applications ( FP , EEA2 and now RC )

At the date of application I was over 5years here . In my application I proved that my spouse have the permanent right to reside in UK and permanent residence unit was dealing with my case .
However , in my card it states ( until 2024 and EU family member ) so I guess it’s another 5 years : )

Hello Guys..i need your help please. I'm so stressed at the moment. my case is,

I applied for retained right of residence and got refused. there are 2 reasons on the refusal

1. HAVEN'T SUBMITTED A VALID PASSPORT.
my solicitor clearly stated on the covering letter that my current passport has expired and applied for a new passport (attached all the invoices issued from the embassy for passport renewal)

2. NO ENOUGH EVIDENCE OF TREATY RIGHTS OF THE SPONSOR (MY WIFE)
I have submitted all the pay slips of my wife during the period of the divorce process till the date of dicree absolute made.

and the appeal right is given.

according to my lawyer she says the home office should have requested the new passport giving a reference number for the passport submission and they haven't. also she mentioned on the covering letter requesting Home Office to check HMRC my wife's employee details if needed. but Home Office refused my application without even contacting HMRC

so my question is, do you guys think the appeal is winnable or should i make a fresh application with more evidence and my new passport which i couldn't submit earlier. Please give your opinions. I highly appreciate

Well, I do not think that without YOUR valid identity they will accept your application. In some cases they can accept no ex-spouse ID but not form the main applicant. I would rather wait for renewal of your passport and then apply for Settled/ Presettled status online under retained rights category.

To be honest, to avoid your application being rejected I would send your new passport to them ASAP by giving them your case ID on envelope and explaining the situation in a covering letter. HI Romy88, i think you haven't red my first post properly. they refused my application giving two reasons. 1. haven't submitted the passport 2.No enough evidence of my wife's treaty rights. and the right of appeal is given. i just want to know is this appeal winnable? or better to do another fresh application. thanks

Seeing your situation i thought to give you a quick advice, mate simply call HMRC ask them to send 5yrs or whatever duration employment history you require being as your partner or ask her and that one page is valid and strong enough to show it all because it is from HMRC already, i only given one page no payslips no p45 and nothing more just a one page in my application and got my positive outcome within 2 weeks.
