Visa Tier 2 Dependent

Hi everyone,

My husband has visa Tier 2 (sponsored by work) and I have tier-2 dependent.
He arrived in the UK for the first time 2 months earlier than me so he will be eligible for ILR 2 months earlier than me.

My husband was eligible to apply for ILR date: 2 March 2019 (he arrived 31 March 2014)
I will be eligible to apply date: 15 April 2019 (I arrived 13 May 2014)
(Our visa is valid till end of April 2019)

My question:
Can my husband apply for ILR now (priority) and I apply on 15th April? As I am his dependent if he gets ILR is my visa still valid within this period?

Your ILR residence clock, for both of you, starts from the date your initial visas were ISSUED and not the date of entry.

Perhaps read the responses you received last year when you asked similar questions. The advice has not changed.

Thank you for your response. Would you please send me the reference that states the ILR eligibility is from visa issue date not arrival? I could not find it in the gov website and it is very important for us as the priority fees will increase by end of March 2019.

This means that PBS dependants may now also take advantage of the following:

The period between entry clearance being issued and the applicant entering the UK may be counted toward the qualifying period. Any absences between the date of issue and entry to the UK are considered an allowable absence. This period will count towards the 180 days allowable absence in the continuous 12 month period. The applicant does not need to provide evidence to demonstrate the reason for delayed entry.

If the delay is more than 180 days, you can only include time after the applicant entered the UK in the continuous period calculation.
