Indefinite Leave to Remain (ILR) for 13 year old

Post by powerpuffgirls » Sun Mar 17, 2019 12:03 pm

Hi

I found this forum of great help. Thanks everyone.

I am tier 2 dependent. Next week I will apply for ILR on the basis of long term residence. My 18 year old daughter got ILR. My husband will apply for ILR next month (once he gets thru Life in the UK test).

My younger daughter is 13 years old and is legally living in the UK for more than 10 years. She was not born in the UK. Currently, she is on Tier 2 dependent (because of my husband). I am not sure when should I apply for her ILR (?nationality). Once my husband gets ILR, she will no longer remain tier 2 dependent.

Thanks in advance.

She could have applied once she reached 1 years residence and meets all the requirements for ILR.

Thanks for the reply.

1) So she can apply for ILR (on the basis of 10 year continuous residence) even before parent's application even though she is not 18 yet.
2) Can she get citizenship without applying for ILR?

1. 10 year ILR means each applicant must meet the requirements individually.

2. If she is NOT born in the UK, then she needs ILR first. Only UK born children have an entitlement to register as British once either parent gets ILR. Your daughter, if born abroad, can only apply for citizenship once she has ILR and once either parent is also applying or is already British and the other parent holds ILR.

Many thanks

Does she need to prove knowledge of English language requirement for ILR (10 year route)?
What I can see knowledge of English exemption is for over 65.

The English test and Liuk yet are not applicable to children or persons under 18 years of age.
