Re: ILR PAYSLIP query

Post by venky55555 » Wed Mar 20, 2019 1:30 pm

HI everyone,

Hopefully, somebody can help me.

I am eligible for ILR from March 7. At present, i am on 32k and i have asked my HR to increase my salary to match the 35500 to apply before April 6 2019. they agreed to increase my salary but salary is going effective from 1st April 2019. so that I have only the old payslip that is with less salary 32 that is march month. If i want apply after 6 April 2019 ILR salary needs to be 35800 which my HR didn't increase my salary 35800 they increased only up to 35500

So i am thinking to apply before 6th April 2019. is that okay can i apply ILR with old salary payslip march month payslip with 32k salary and my HR will provide me the Letter about increment salary and they have updated sponsor management system about my new salary also.

shall i get the application successful or not??/ or am i taking the risk??

Thanks

You are required to submit at least 1 months payslips and bank statement proving you meet the ILR salary requirement or what is stated in your SOC, whichever is HIGHER.

You must meet the salary requirement on the date of application and the date of application is the date you submit and pay online on form SET(O) and your supporting documents can't be older than this date.

Thanks CR001 for clarifying me.

So if i submit the march month payslip with 32k salary and a letter from HR saying my salary increased to 35500 is that enough for my ILR application?

Unlikely. You need evidence that you are earning the required ILR salary when you apply.

so what you are suggesting is salary increment letter is not enough for my ILR application

No, I don't believe it is sufficient as HO wants to see that you are and have been paid at the level required, hence why they want to see payslips and bank statements.

You should also be aware that if only you got a £3,500 increase in the company, it is likely to trigger an HO visit and investigation.

It is my salary annual review. I achieved some objectives. are these are fine if they try to come and do an investigation

Please tell me do I need to submit the ILR application or not? I am so confused now ??

As CR001 suggested above it's better for U apply after U'll have at least one payslip with qualifying salary. Also U can apply now but most likely Ur application will be refused because salary requirements weren't met.

Just update on this
I have asked my HR to give the Paril month pay slip. They provided me and I have applied for the visa with April month pay slip and last month bank statement of March month salary both are different salaries. My HR provided me the Confirmation of employment and confirmation of absences and confirmation of April month pay slip.

I have applied for the visa on April 2nd
received an email on April 3rd that saying visa has been granted.

I have got the visa with super priority service.
