Hello,

I have been living in the UK from 2009, I started my full-time job on 1st of March 2014, however, I was on PostDoc visa. I received a letter of approving my tier 2 visa on 27/5/2014, while the date on the BRP 28/5/2014
Q1: When earlier I can put my application forward (5 years route)?


On ILR continuous period calculation document (HO website)

"Applicants can submit a settlement application up to 28 days before they would
reach the end of the specified period.
You must calculate the relevant qualifying period by counting backward from
whichever of the following is most beneficial to the applicant:
• the date of application
• the date of decision
• any date up to 28 days after the date of application"

Q2: Does that mean, it should be fine if I complete my application now for the new service, and upload my documents and go for biometrics meeting within 28 days (considering that, the decision will be made within 24 hours from the appointment date and therefore satisfy the second point in the regulation?

You must apply within 28 days before the 5th anniversary of your tier 2 visa issued date.

Date of application is the date you submit and pay online and NOT the date of your Super Priority service appointment. If you apply now, you don't meet the requirement.

Is 30 of April is the -28 day? I tried several websites to calculate the date but they give different results

Also how you explain the statement above from the home office?

They didn't say it must be the date of the application, they also said or the data of the decision whichever is most beneficial to the applicant?
