Hi everyone,

We have an appeal on 23rd of May for a refused FLR FP based on 7 year rule.

My solicitor somehow decided it was a great idea to apply when my daughter was 6, born in the UK but 6 years old. HO refused stating the application was refused as at the time of application she was 6 years old and didn't qualify.

I am now, after considering all options, trying to prepare a bundle for the appeal and have decided to part ways with solicitor. I will though, have a barrister to act for us in court.

Can anyone help with their own experience preparing bundle?

Any advice please.

I am a bit unsure how to do the witness statement and applying the case laws. My daughter turned 7 in October 18 and will be 7 years and 7 months old at the time of the hearing.

Any help is much appreciated.

I have 5 years Irish resident card, I am living in the UK since January 2015. I applied to EEA(FM) two times, but they refused it.
My partner is British, we are married for about 6 years. We have 2 British kids 4 and 2.5 years old. We are living together.

I have applied for flr(fp) : 3/August /2018

Biometrics letter received : 11/9/ 2018

Biometrics done: 11/9/2018

I contacted local Mp, homeoffice replied that my case is complex in nature.
I am tired of this game😞😩 I lost 7 years of my precious time just because I married to a British guy. It is not fair... I lost my career..... 😩...... I am still waiting.... I don't know leave my kids and my husband alone or living like this..... This is really a psychological battle... 😭

Hey, i am sorry to bother you. When you got refused, how long fid it take you to get a hearing date after your lodged in the appeal and when you went to your hearing, what was court like ?

I just got a call from my solicitor this evening telling me the application has been refused with in country right to appeal.I do not even know how to feel, because waited so long only to get a refusal.

I haven’t seen the reason for refusal yet as i will be going to my solicitor on wednesday.

I’d like some advice on what next to do ? whats the best way to go about refusals under this category with right to appeal.

What did they mentioned as a reason?
I have not seen the letter yet , i'll take it tomorrow from solicitor

Hey, you're not bothering at all.

We haven't had our hearing yet. It will be on 23rd of May.

It took about 4 weeks for the notice of hearing.

Thanks for getting back to me.

The whole thing makes me so anxious,

Good to know that the waiting time to get your hearing wasnt bad, It gives some kind of hope.

I read somwhere it could take from 8 to 52 weeks. I was like what ?! Waiting for another year!!

I'll be going to my solicitor today and we will lodge the appeal today and i hope for the best.

The wait is nerve wrecking.

We went for appeal on 11 feb still waiting for decision .court room will have judge , 1 of your solicitor,1 guy from home office , home office guy will ask you some questions n judge as well .dont get panic it’s not tht bad how it sounds .jus b calm and answer all questions correctly .your solicitor will also speak about your case .judge was really nice lady .they might ask u what was your intention when u came here so jus prepare for tht answer .hope tht helps 👍best of luck

Good night all..... Ive been following the conversations for a while and was wondering if could seek some advice. Ive recently submitted an flp parent of british child application in december 2018. I am an overstayer for almost 10 years. I gave birth to my child on the Nhs paid half the bill and paying the the balance in monthly installments. Im living in the same house as my child's father as i have no place else to go (we are no longer together but he has allowed me to stay in his 3 bed property) My ex works full time and in shifts so i have sole responsibility for my child.. Do i have a strong case?.....any advice would be great appreciated... Thanks in advance

Asked more info by ho -feb 2019 (wife disease )

    Sounds scary, i'm not even going to lie. I've lodged my appeal now.

    Waiting to get a date for hearing, also monitoring my bank account to see if they've taken the fee.

    Could you please clarify what you meant by , "They might ask you what your intention was when you came here?"

    and also whats the best way to answer?

    Hi meet32 so if you dont hear anything after additional documents does that mean it will be refused? i have not heard anything for two weeks.

    Yes it was our first application, FLR(FP) partner route. There was an automatic right of appeal with the refusal, I believe it’s always been this way but I could be wrong.

    Hi Auk333,

    Visitor visa overstayer by 4 months. Submitted FLR(FP) Partner Route based on Human Rights Article 8. Never had to report and have no kids.

    It was always my understanding that these cases have automatic right of appeal. I'd suggest you speak to your solicitor if you have one.

    What I've learned from this experience is that the HO makes plenty of mistakes and if you have a strong case you will eventually get your leave to remain, it's just a matter of how long it takes the HO to reach that decision.

    Again, I wish you the very best of luck. I know how excruciating the wait can be.
