Appendix Eu (Family Permit)

There appears to be a potentially troublesome requirement for a family permit under the immigration rules:

Appendix EU Family-Permit wrote: FP6. The applicant meets the eligibility requirements for an entry clearance to be granted under this Appendix where the entry clearance officer is satisfied that at the date of application:

(a) The applicant is a non-EEA citizen;
...

This may cause a problem for ethnic Italians. It is a slow process for Italian citizens from Brazil to obtain the first official confirmation that they are Italian citizens, and I don't think this issue is restricted to Brazil. It may not be straightforward for bearers of Italian surnames to satisfy the ECO that they are not Italian citizens.

There is no prohibition under the EEA Regulations on issuing a family permit to a person who may be an EEA national.
