Kindly help.....Spouse visa financial requirement !

Post by Sam94 » Thu Apr 11, 2019 10:44 pm

Hi there,
I made a spouse visa application on 8/3/2019, biometrics done, documents posted to Sheffield. Now I am kind of confused when it comes to financial requirement. I know this sounds silly that I already made an application and selected category A for the financial requirement but now I am perplexed if I did any mistake.

Exact situation - I started working with my current company on a salary of above £18,600pa from 3/9/2018 and am still working with the same company. How I got payed by my company....for the first month they payed me from 3rd September until 14th September and there after it’s on monthly basis, which is I get payed on 15th of each month. As part of my spouse visa application I am showing 6 payslips from 14th October 2018 until 14th March 2019 and 6 months bank statements from 15th October 2018 until 15th March 2019.

Now the big question is if it’s okay to show the payslip of 14th March 2019 and bank statement of 15th March 2019 which will be after the date of application (8/3/2019) ???

Just to let you know I don’t come under category B as I am employed with my current employer for more than 6 months on the date of application (8/3/2019).

Documents attached as part of the financial requirements....
Payslips from 14th October 2018 until 14th March 2019.
Bank Statements from 15th October 2018 until 15th March 2019.
Employer contract.
Letter from employer with details of job profile, type of employment, date of employment started, salary and genuinity of pay slips.

Any sort of advice and help is highly appreciated, thanks in advance.

Under category A the payslips and bank statements must at least cover to 6 months instead 6 in number. Based on above dates you might have missed documents of nearly 1 month. Ho has no discretion over it.

If I were you, I would seek the advice of an immigration expert immediately. As seagul says, there will be no discretion shown by UKVI. If you do not demonstrate the full six-month period as required, your application will be refused.

An immigration expert might tell you that it would be better for you to withdraw your application. If you are absolutely sure that you have made a mistake, you'll basically be waiting three months or more to receive a refusal. Three months wasted.

An immigration expert might also tell you that withdrawing your application would be better that having a refusal on your HO records.

Thanks seagul

What can I do now ?
Even though in my sponsor cover letter I have mentioned clearly that I am working since September 2018 with a salary above £18600 and I will be providing 6 months payslips and bank statements. Now I am thinking of sending a supplementary cover letter to correct the mistakes(wrongs dates for 6 months payslips and bank statements) made by my solicitor. I already sent the payslips and bank statements from September 2018 - March 2019, it’s just that the solicitor representation letter have got the wrong dates from 14th October 2018 - 14th March 2019 for both payslips and bank statements.
Kindly suggest wether it’s a good idea to send a supplementary cover letter to explain the mistakes or should I let the eco go by what I provided as the supporting documents for financial requirement.

As I see it, with an application date of 8th March, you will need to demonstrate, at least:

Payslips from 8th October 2018 until 8th March 2019.
Bank Statements from 8th October 2018 until 8th March 2019.

If you enclosed these within your supporting documents, I can't see what the problem is.

The solicitor’s representation letter on the top of the application mentions wrong dates which are from 14th October 2018 - 14th March 2019. This is the only reason why I am concerned.

If you've enclosed with your supporting documents:

Payslips demonstrating pay from 3rd September 2018 until 8th March 2019
and Bank Statements demonstrating pay from 3rd September 2018 until 8th March 2019

I don't think you'll have a problem.

I think the ECO would gloss over the slight error made by your solicitor in his letter.

Others might advise differently.

Sam94, Congratulations on the successful outcome of your application and bet you are enjoying the good life of being with your family.
Thanks for getting on here to finally give the feedback.
However (and presuming your decision was made a while back) will encourage members of this forum to give update/feedback on their application no matter what the outcome is. It helps in contributing to the body of knowledge available.
I note that Moderators and varying degrees of members on the forum will clearly tell you they do not know it all so feedback on each and every type of application no matter how straight forward or peculiar will be definitely come to be of relevance to someone or the other.

Thanks all.
