I don't think that would be causing trouble looking at section 3.2 am really confused

This does not include persons who held an employment permit and an

Yes i was never an employment permit holder i was only on temporary stamp 1 to enable employer to apply for a work permit which i never acquired. I was issued these temporary stamp as i made efforts and kept engaging with the authorities to remain legally in the State. So basically this means that it would have been better if i was issued no stamps at all and stayed on

I was issued in 2018 a temporary stamp 1 without the need of a work permit as i had a job offer

I can be wrong but I think your last stamp1 for one year was the problem for them. In 2018 many people got stamp1 for a year and you are may be one of them. you don't need to worry because you will get extension on your current stamp1 and eventually at some stage you will get stamp4. at the same time you should be in touch with your lawyer as your status was never changed to work permit or eufam.

can you please let us know that when you first lodged the application in this scheme. how long did they take to answer you etc....?

Guy's.. do you have any idea (Even from solicitor view) that if the Department not considering change of stumps student under this scheme then how they get their permission back?
Even those student were here legally in between the year 2005-2010!!

I applied for the scheme in October got reply in Feb. Sent review for refusal in Feb got reply back in April.
I don't understand how my last stamp was the issue as section 3.2 clearly states that the person that the person is eligible if they have had at least two years resgistered as a student including Temporary stamp 1( without the need for an employment permit) which was my last stamp.
I think whoever changed status from stamp 2 have less chance of positive response
I also had some administrative errors from the reviewing officer refusal letter which is a juridical mistake.

Mar_ir,

The last option is humanitarian application and it takes 2-3 years at least. There is no such policy to conclude such application within time frame. Its totally Minister discretion. Its bitter truth my friend.

Normally they issue temporary stamp 1 for shorter period to seek employment permit.

On what grounds you got your Stamp 1 for 1 year in 2018 ?

I was issued 4 months temporary stamp 1 on 3 occasions to seek for a work permit which was unsuccessful. 2018 i got a job offer letter so i put an application requesting for permission to work, i was issued temporary stamp 1 without the need for an employment permit for 1 year.

Section 4 is much quicker within 2-3 months. Some got in weeks, depends on your immigration history. Don't lose hope.

Your application approved under section 4(7) of immigration Act 2004 and they issued you Stamp 1 for one year. Your student status changed in 2018. This is temporary stamp but its not similar to your previous stamps which you got in 3 occasions. I am sure they will renew your Stamp 1 subject to some conditions. For that reason INIS refused your application.

The reviewing officer did mention on my refusal letter that i can renew my current temporary stamp 1. I will apply for a renewal and hope for the best.
So section 3.2 on the scheme is totally invalid

Sorry to hear about your refusal but like others are saying you will be able to renew your stamp 1.I have a friend who applied for change of status before the scheme came out,in her letter Inis gave her stamp 1 for 1 year in December'18 and advised her to apply for the student scheme and also let her know that her stamp 1 was renewable.It was her first time to change status from stamp 2 to 1 in December.So I wonder if she will get positive outcome after your situation.
