Tier 1 Entrepreneur to Tier 2 General

Hello team, I am Nahid

I am currently in the UK on a Tier 1 entrepreneur.

Now I would like to switch over to tier 2 general visa due to difficulties facing in current leave to remain. One of the UK firms agreed to sponsor me under tier2 general as a software engineer. I have rich experience in Software domain.

Advance thanks to someone who will reply to below questions


1) I have done my masters (African literature studies) in the UK, Shall I use these masters to claim points under the english language requirement?

2) Since my academic background is literature studies, is there any chances HO refuse my visa application based on the fact that my academic qualification is no way related to the work I have to carry listed in COS?

3) Section 3c was curtailed in tier 1 entrepreneur during the extension period( I got the extension in the second application). Will HO cross check with the tier 2 company on what basis I have been recruited since I have no work rights during the period of extension process?

Have you been refused your tier 1 extension? If so how long ago, are you still in the 14 day period post refusal?

Have you received a COS from the Tier 2 Sponsor? Was there a RLMT undertaken?

Your qualifications do not matter in this case, you are being employed to do a role supposedly on your ability and because a settled worker is not available to do the role.

Were you contracting for the company that is willing to sponsor you?

Yes, back in March -2018 but got approval in 2019 - Jan in the second application

Have you received a COS from the Tier 2 Sponsor? Was there a RLMT undertaken?


As they mentioned[Tier 2 employer], They have already published an advert in relevant portals, I applied to one of their job adverts. but still, 28 days yet to complete. After this, they will start the process by issuing COS.

Were you contracting for the company that is willing to sponsor you?


No, I just applied to the job advert

There are no obvious concerns or barriers in your case to switching to Tier 2 from Tier 1 Ent.
The only pitfall could be the RLMT not being fair and open as you already know you are going to be issued a COS despite the advert is yet to run for 28 days.

As the recruiter said, Initial advert has been posted for 14 days they again extended it for another 14 days.

I applied 17th day from the date initial advert has been posted.

I still miss the point to understand how RLMT will work.

RLMT must be completed BEFORE they can offer you the job and request/assign a CoS.

Is mentioning salary mandatory in RLMT? In my case, my employer mentioned as "Market rate - dependent on experience"

4 years on tier 1 entrepreneur plus one year on tier 2 general - Do I still need to keep all the documents of my Tier 1 period e.g. employee payslips, p60, etc.. when I apply for ILR through tier 2 general route

As CR001 has pointed to the guidance - a salary range is mandatory for the job advert to meet RLMT. General comments such as “market rate” do not meet the requirements.

Hello CR and Frontier,

Upon checking the Tier 2 sponsor guidance, Yes, It is required to mention the salary range for a valid RLMT.

If I understand correctly, The company has to conduct a fresh RLMT with a salary range. In this case, shall I remind the company of the same? I am in big confusion now.

I would ensure your Sponsor is aware that the salary range is stated in the advert.

In one year time, I am eligible for ILR through tier 2. my question is, what are the documents I will have to keep for the period I spent on tier 1? for e.g. employee payslips, p60, business bank statements, etc...

Do I need to submit all the above-listed documents with ILR application? if not, how come HO will understand my visa related activities during the period of tier 1?

The Tier 1 period is not examined. If you are applying for ILR based on Tier 2 then the issue I’d wither you meet the ILR threshold at the time.

The only Tier 1 carry through will be that you declared your accounts to HMRC and if any tax was due you paid that amount.
