As an extended family member, you have no automatic rights and Section 3C does not apply to EU EFM applications. You therefore appear to have had no status from date your RC expired to date of settled status granted.

CR001, the OP's very first post suggests that s/he had received an RC as the EFM of an EEA aunt in 2012 and subsequently, his child was issued a British passport on the basis of his having acquired PR. But he was refused a PR card.

To the OP, you can apply. But given the circumstances, there is a chance that your naturalisation application will take much longer than normal. It is not straightforward.

Thanks for your reply

Please tell me how honest you know about the law please educate me
1. I didn't have leave i secured my son British passport.
2. I didn't av leave i was given right to work and exercising treaty right.
3. I didn't have a visa... i had rights under European law
4. The Tribunal is always there to listen to both side...
5. There's nothing like blacklist on how many times you apply under EEA route. Just to keep you posted a guru (secret.semon) said it possible just not straight forward and it will take time for decision.

Thank you

You are extended family member of an Eu national
You have and had limited right of residence

Direct family member have automatic right of residence

When you apply for British citizenship home office will check your last 10 years history

- if you have broken any laws
- if you paid tax on time
- if you have broken any immigration laws
- if you were legal resident since you arrived in the U.K. within last 10 years

For extended family member your right only confirmed when your residence card is issued
No RC - no right
UK Student Visa : 04/2004 - 09/2009
EEA Residence Card : 07/2010 - 7/2015
EU Settled Status: Confirmed on 16th July 2019
Naturalisation : Confirmed on 02nd Oct 2020

Read paragraph 9.
The relationship broke down so reg 15 (1)b was not met in that case which you posted.

My case the relationship is still intact i still maintain reg 7(3a) and reg 8 with a pending application with my EEA Aunty supporting documents. We were never separated.

https://www.freemovement.org.uk/extende ... no-rights/
This is talking about if you have never been issued a RC and you claimed co habitation will no give you right to PR.

In my case i have been issue RC till 2017 and 2018 i secure my Son a British passport..... while my PR application was pending coa issueed and continuous treaty rights exercised.

I table this with ukcen and i got a valid response like that of secret.simon. so my friend u av done well..... i will keep you post next year. Thank you 🙏
