No response on the CoS as well as the email my HR had sent last thursday. Its so frustrating to wait. Just wish they had Jarvis to skim through all applications :P ( Especially now he/she/it is free)

HR emailed me and believes since there was no additional information requested, that my application is being carried over into May.

Same here no emails no confirmation so far. Last month people got theirs even as late as 5th April so lets hope it passes through or some information is requested.

I believe they will be approved. I'm an endless optimist, however, I'm not sure we've been given a good reason for them not to be. I'd imagine that if there was something wrong, they'd have requested more information and if they had cause, they'd have rejected by now. I think it's just a volume thing. Or they're waiting to see who, of those requested for more info, won't come through and they'll allocate those certificates before the May deadline. We're prolly in that queue.

Employer submitted documents on 2nd of April and additional information was asked which was submitted on 7th April.
CoS is approved today 😊 all the best to all who are still waiting. :)

Unsure on the rest. I believe it had to do with my salary more than anything - my employer was requesting less than what HO was requiring by appendix J for experienced salary.

Well yes, then it would be refused. Your salary must be at least what the SOC states for experienced, ie £35,800pa.

Just got a reply from my HR as well. CoS has been rejected she hanst been given a reson or no email as to why this has happend. She could see on the portal that its been rejected and there is nothing else mentioned.

CoS was applied under SOC 2136 and my salary was/is above the limit. (£60000)

Is there a way to identify/understand why it was rejected ?
Any help would be great.

They should have waited till your 12 month cooling off period was done in June. You were advised of this previously.

Yes the start date requested start date was June end and it was RCoS as per SOC requirements.
Also we had applied for two COS one for me and one for a new joineer from Russia but both have been rejected.
Do they email ? Or send a letter or something as to why the CoS was rejected ?

An audit is never a good sign. There is every chance that the COS allocation is being held up and it is likely to remain that way until the audit is completed.

I am a little confused - are you looking to come to the UK or are you already here looking to join the Sponsor or extend your current visa?

Hi, sorry, I'm not so clear on everything either. My employer is UK based. They are a grade a (?) Sponsor as they are fairly large operating transnationally. I am Australian and have been offered a job with them. They ran a market labour test in march and submitted for a RCoS at the start of April. I'm confused because I asked them how many points they submitted the application with and they told me the points system doesn't apply at this stage. Anyway, they are being audited by HO which they said is an annual thing. I'm worried it will impact my application and they can't seem to tell me if it will and how long the audit will take. All in all I've had to wait since last December.

The Home Office does not audit Sponsors annually, so there is an issue with your Sponsor. The only reason the Home Office audits Sponsors is because there are probably issues or perceived issues.

Are you joining an IT consultancy type business?

No, not IT..they are engineering. Would this make a difference?

There are issues in regards Sponsors acting as employment agencies and hiring out staff on Tier 2 visas as IT contractors. This is not allowed under Tier 2. Hence the question on what industry sector. There is presently a secondary trend for this to happen in the car/ truck design / engineering areas, as there are a couple of huge design contracts out there at the moment.

An on site audit would last no more than a couple of days. The report and evidence submission is made in around two weeks after that. The decision on the audit outcome can take a few weeks and then if there is intervention action it goes on for months thereafter.

If your Sponsor has gained an RCOS then they have it in hand and can issue it to you, audit or no audit. I think they either missed the boat for the April allocation or they were not granted an allocation. Points very much matter at this stage because if there were more RCOS applications than allocation then it is highest points wins.

Guessing one way or another they have not got a RCOS to issue you with.
