Switching from Tier 2 Dependant to Tier 2 General within the same employer

Hi everyone,

I have the following tricky question: if person with Tier 2 Dependant visa is already employed by a particular employer and this employer is willing to move the worker to Tier 2 General status (RLMT was held, RCOS has been granted), can this person still work for the company while Tier 2 General application is under review? I definitely know that person need to make entry clearance and leave the UK to submit his/her application in home country and stay there until application is approved/rejected. But does employment need to be terminated as well for this period? I mean, should this worker be fired from the company before submitting Tier 2 General application and then hired back after visa has been granted?

I have the same question as i am in the same position. Can anyone please shed some more light if there could be any issues if i continue with the same employer (i recently got my restricted cos from the company that iam already working for ) and would be going to back to my home country to apply for tier 2 Gen. visa
