Tier 2 to ILR - Application Date

Post by compiler2000 » Wed May 22, 2019 8:39 pm

Hi,

I have a confusion in regards to ILR application after Tier 2.

I got my Tier 2 (5 Years - Switched from Tier 4) with following details:

CoS Assigned: 18 June 2014
Work Start Dates: 15 July 2014

Dates of BMR:
Valid from : 29 Aug 2014
Expires: 15 July 2019

When can i apply for ILR with the above dates.

No sooner than within 28 days before your visa start date.

generally when we apply for tier 2 for 5 years then leave duration is 5 years 14 days so is it a mistake on my bio metric
my tier 2 application date was 9 July 2014
cant we do something else to cover 15 days

What were the dates on the cos?

If the end date was 15th July, then that is when your visa would expire.

Tier 2 - 5 Years (Switched from Tier 4)
CoS Assigned Date: 18 June 2014
Start date: 15 July 2014
End date: 14 July 2019

Tier 2 Application Date: 15 July 2014
Visa Start Date: 29 Aug 2014
Visa Expiry: 15 July 2019
Absents from Work: Zero

These are the dates. and what I believe since it was 5 Years application so leave granted should be 5 years and 14 days OR job end date plus 14 days. So do you think any grace is available to cover 15 days

And can any one explain this para:

Calculating the specified continuous period
Applicants can submit a settlement application up to 28 days before they would
reach the end of the specified period.
You must calculate the relevant qualifying period by counting backward from
whichever of the following is most beneficial to the applicant:
• the date of application
• the date of decision
• any date up to 28 days after the date of application

Dear All,

I contacted home office for expiry date correction although its 4 years now but they have changed it free of cost and send me new bio metric.

Visa Start Date: 29.08.2014
Expiry: 29.07.2019

Can I apply for ILR on 25.09.2019 and book appointment after 02.08.2019 by following this rule

Calculating the specified continuous period
Applicants can submit a settlement application up to 28 days before they would
reach the end of the specified period.
You must calculate the relevant qualifying period by counting backward from
whichever of the following is most beneficial to the applicant:
• the date of application

There still is a small gap. As per your visa dates, the earliest you can submit the ILR application online is 01st July 2019. Submission date is the date when you pay for the application. Appointment date is irrelevant for calculation purposes. There is still a 3 day gap.

CR001 or Mods can confirm if there's a workaround to bridge this.

Why do you say 1st of July??

The earliest the OP can apply for ilr is 1st or 2nd August based on visa issue date of original visa.
