Tier 2 (General) to Tier 5 YMS

Post by throaway_awau_away » Tue May 28, 2019 3:51 pm

Hi everyone,

Background information
- Australian citizen under 30
- current Tier 2 (General) possibility of no renewal
- would like to stay in the UK, I also have a British partner

My initial idea is if worst comes to worst, I go back to Australia to get a Tier 5 YMS but I'm worried as to how the application will be perceived by the Home Office given that I previously had a Tier 2? Since the Tier 5 is meant to be temporary visa. I'm confident I satisfy all other requirements: passport type, age and funds. Nor do I have any previous visa refusals in the UK or any other country. Unless I get the letter or curtailment but I can return to Australia before that. No criminal record either.

Then all going well with my partner I could get married and switch to the spouse visa before the 2 years of Tier 5 is up. As I'm worried we may not have enough time for the notice period to the registry etc... and also how that will be perceived if I go straight to the spousal visa?
We currently don't live together, we do meet the minimum salary requirements.

Thanks for any advice/help

How long have you been with your partner?

Do you live together, and if yes, for how long?

When does your tier 2 expire?

There is no reason a tier 5 will be refused if you meet the requirements by the way.

At the end of June, then I guess there's the 10 days period to let Home Office know, plus the letter and the famous 60 days.

There is no reason a tier 5 will be refused if you meet the requirements by the way.
Even due to previous visa being curtailed? I ask as I'm seeing a slight cooling off in jobs on the market in my field, don't know if Brexit related or not, so just trying to explore all options

If your visa expires at the end of June then there is no curtailment letter or 60 days. You must leave the UK by the last date of your visa validity.
