You can send any documents later on and HO will consider that BEFORE a decision is made. Most likely if you apply in July your application will take a couple months to be processed - Tier 1 Ent ILR is taking around minimum 4 months to be processed these days.
I applied on 1st Jan 2019. I sent my (Jan 2019) FPS on 15th Feb 2019 and sent Feb 2019 FPS on 1st March 2019 (I was just double minded if I should send as I already met the requirements but cz my monthly salary slips showed 120 hours and 150 hours, I decided to send extra one month on 15th Feb 2019 and another extra month on 1st March 2019 just to be on the safe side).

Both documents were considered by the CW and they actually returned me the docs with the approval letter.

If you apply in July 2019 you can generate an early FPS for July 2019 or you can send by end of the month. Similarly you can send FPS for Aug 2019 in end of Aug 2019 if your payslips also show 120 hours.

Any docs you send before a decision is made will be considered. Attach a cover letter, mention your Case ID and post with special delivery to:

Sheffield
S3 8WA

Note: My accountant also provided me with a weekly breakup of employee hours and I submitted that with my application which showed exactly that my employees worked 30 hours/week.

Yes. The ones I sent to Durham address had a note on the top with a pen to be sent to Sheffield(whoever received that at Durham address sent it to Sheffield then via HO internal mail). But I did not take any chances and sent again to the correct Sheffield address later on. All documents were returned to me (Durham plus Sheffield address one).

Thanks for your reply and info.

Its good to know that they consider the docs sent before a decision is made. It would be beneficial to me I guess as two of my employees who are working a minimum 130 hours/month will finish their one year by Sept2019. Then I wouldnt need to rely on combining PT'ers to make FT JOB.

Senior members please confirm Is my arguement is correct? And can I rely on this.

I have given all the employees names with E and a letter for a better understanding for all.

Joining date of a employee is the month where the hours start. For example E1J Joined in June 2018. E9B Joined in April2019.

I have mentioned when a emp left the job in that particular month. For example E1J Resigned in Nov2018, E2P resigned in Jan2019. E8D resigned in Jan2019 and joined back to business from March 2019.

Currently E3V,E4K,E5A,E7T,E8D,E9B are still continuing in business.
Assuming E3V,E4K,E5A,E8D, work 130hours/ month for MAY ,JUNE where as the remaining above employees work less than 130 hours in a month.

Will I suffice the Job requirement criteria?

Marcnath and Aman please give me your responses.

You seemed to have been qualifying from ur first post as well.. you confused the situation by mentioning too many employees and then 8 part time employees against 6 months with them performing full time hours.

No. The gap makes no difference. I explained earlier that the jobs don’t need to be performed consecutively.

1. E10+E4= 10 months (june-April) + May + June

2. E3+E7=10 months (july -April) + May + June
or
3. E1+E3+E7=11 months(june-April)+ May

1 & 2 is preferable.. one less employee info.

Now this is assuming they all started first day of month and left last day.

It’s possible. It should work as the 12 month required job creation after ext should include the time after application as ur still continuing under Tier1 conditions..

Thanks for your response. Sorry for initially confusing.
I have a sigh of releif :D now that job creation is sufficed. Now I can start getting the docs ready and concentrate on other aspects of application.

Aman I did read in the guidance it said that the job doesn't need to be Consecutive' for transitional arrangements,does it applies for Non-Transitional applicants? I might be wrong as I have read it few months back. So only just double checking.

Just rang my Accountant got the info. Start & end date of E10 is 16/05/18 - 28/07/18. and for E1 16/05/18-18/11/18.
E4 start date is 16/08/18- Continuing
E3 start date is 16/06/18-Continuing
E7 start date is 15/07/18- Continuing

Aman please let me know if it is fine.

Also to mention E10 British Pass port is expired in 2014 and I have the copy of Expired passport only. Would this be an issue?

Marcnath could you also please take a look and confirm am I in the right path.

As far as I know there is no requirement for jobs to be continuous. As long each job has existed 12 months after extension you are fine.
