switching from ICT 2 Dependent to Tier 2 general

Post by aspirant910 » Sun Jun 16, 2019 11:30 am

My spouse has been working on ICT Tier 2 visa since July 2018 for a UK based company. Her ICT Tier 2 visa is valid till July 2020. They have performed the relevant process ( RLMT etc) and have got an RCoS and have assigned to her. Her CoS start date is 1st August 2019 and she is in India for a family emergency and wish to return to UK asap.

1. Can she apply for Tier 2 visa and travel to UK during this month . The guidelines say that you can start 15 days before the actual CoC start date which will be around 15th July.
2. Does she need to submit her ICT Tier 2 dependent BRP card as well with the Tier 2 application?

Please suggest.

1. She can apply for the T2 General visa now. However, even if she gets the visa before 15th July, dont think she can travel before that as per the guideline.

2. Not required to submit the actual BRP. You may need to attach a copy of it since there should be a question in the application form about her previous visit to UK.

Do note that once she applies for Tier 2 visa, she will not be able to travel on her T2 ICT dependent visa until a decision on her T2 general application is made.

so does that mean ICT tier 2 BRP will be no longer valid ? or she can still travel.
I am confused.

ICT visa is cancelled once the Tier 2 general visa is granted. She must enter the UK on her Tier 2 General visa vignette to activate the visa.

If Tier 2 general is refused, no effect on ICT visa.
