Dear Experts,
Please help!
* I came to the UK on 23/08/2009 and had been on tier 4 visa until January 2018 and then switch to tier 2 visa got a visa until August 2020.
* My wife came to the UK in June 2017 on tier 4 dependent visa and then switch to tier 2 dependent visa, got a visa until August 2020
* We have a son, born on 05/01/2019 and we haven't traveled since he was born. Moreover, we haven't even applied for his Nepalese passport as I am waiting for the ILR so that he can be directly eligible for a British passport.

I am applying for ILR- LR 28 days prior to 23/08/2009.

Now, before filling in an online application for ILR- LR, I filled in a dummy application. I have all the documents ready apart from the following which is confusing

1. Document(s) showing your child/children's immigration status such as passports, biometric residence cards, or vignettes
2. Evidence of a father's access to a son, such as a written agreement between both parents or a child arrangement order

Questions,

1. Do I need to apply for a Nepalese passport and visa for my son?
2. Do I still need a written agreement, whereas my wife and son live with me? if so, where can I find a template?

No. Your SET(LR) application has nothing to do with your dependants.
Just remember that your wife must switch to FLR(M) after you get ILR which resets her ILR clock

Dear Zimba,

Thank you for the prompt reply. As you mentioned, SET(LR) application has nothing to do with my dependents. However, while filling in the Set (LR) application, it says I need to show my child immigration status such as passports, biometric residence cards, or vignettes.

How long do we have to switch to FLR(M) after getting my ILR? Is there any time limit as my wife has a visa until August 2020?

Ignore the online list that is not accurate. There is no timeframe but your wife should apply for FLR(M) after you are granted ILR and as soon as she can because her PBS visa may be curtailed.

Dear Zimba,

Thank you for the prompt reply. We are planning to go back home for about 2-3 months as soon as I have been granted ILR, Moreover, I am also going to either quit my job or change, therefore will it be alright if my wife doesn't apply for FLR(M) until her current visa ( PBS Dependent) expires or we receive a curtailment letter from homeoffice?
or
Can she apply for FLR (M) once we have come back from holiday?

She should switch visas before travelling out of the UK.

She risks being refused entry if she tries to return.

You should also not quit your job until she has switched as you have to meet the financial requirements with at least 6 months evidence for FLR M.

Thank you for the reply. Will it be ok to show last 5 month payslips from old employer( current one at the moment) and one month payslip from new employer( future employer) if i change my job? Moreover, the new job would offer me more benefit packages than current one.
Or

You need 6 months payslips if you have one employer or 12 months if your new employment is less than 6 months. You can only use salary to meet the financial requirements, no benefits offered by employer.

You cannot use 'borrowed' money or third party support. If you want to use savings, you have show a minimum of 6 months evidence of £62,500 and potentially source of funds.

Dear Experts
I came to the UK on 23/12/2009 on tier 4. Last year, i switched to tier 2 visa. As you know i will be eligible for ilr on 26/12/2019. However, my employer gave me 30 days notice and my last day of the employment will be 05/08/2019.
Please answers the question below
1. Is my employer allowed to inform home office before 05/08/2019? If so, i believe he must have informed the homeoffice about my leaving employment.
2. How long does the home office take minimum to send me a curtailment letter?
3. What’s the duration for the curtailment letter? Is it 60 days or even less?
4. If i apply for flr after the expiration of curtailment letter, how long minimum will i get?
5. How many days will i have to do biometric after applying for flr?
6. What are the options do i have to buy time until 26/11/2019?

I would really appreciate it if you could answers the questions as soon as possible?

2. It can take a few months.

3. 60 days IF your current visa is valid for longer than what a curtailment period would be.

Thank you very much for the prompt reply. I don’t know to be honest which flr i would qualify for. Which flr should i apply for in order to qualify for ilr easily?
How many minimum days will i get to do the biometric once i have made the application for that flr?
