Tier 2 Dependent Extension while Main applicant is on ILR

Hi All,

I really need an advice from you.

I recently got ILR (via 5 year Tier 2 General Visa). My dependents (My Wife and 2 children) are currently on Tier 2 Dependent Visa and their Visa is expiring in September 2019.

Q1). As I moved to ILR, is my dependents visa still valid until September 2019 or Do I need them to change to different category?

Q2). In which category, Do I need to apply extension for them? (Tier 2 Dependent Extension or any other category)?

Q3). Can I apply ILR for my children as I am already on ILR?

Q1. Visa remains valid.

Q2. PBS dependent.

Q3. Children will qualify for ILR when your spouse does if they are born abroad.

Hi CR001,

I am going to apply for PBS Dependent Extension for My Wife and two children sooner, if they got the 3 years Dependent VISA then they will have 4 months short of for ILR eligibility. Which means they have to apply for Dependent Extension again which really costs me huge amount of money.

Is there any possibility to cover that 4 months shortage just to save money?

There is magic cheap route to cover 4 months if they are short for ILR. They would need to apply for another 3 year extension first.

I would suggest you apply for their extension as close to their visa expiry date in September as possible and apply using standard service which could buy an extra 8 weeks time.

Thanks for your reply. Really helpful and I understood that.
But even if UKVI take 8 week to give us the decision, still 2 more months of shortage for ILR.. right?

Is it possible below (please validate) ?
I will submit the application and pay for extension in September just before expiry date but book for the appointment very late.. will this cause any problems ?

Date of application is the date you submit and pay online however if you delay your biometrics just a bit, then yes you can buy some extra time.

What date was their initial dependent visa granted??

Thanks a lot for your reply… and I started filling the application form for my wife and children… and have few below queries...

Q1. Person you are applying to remain in the UK with?
Am I correct that I need to provide the details of me?

Q2). Is Mr XXX job comes under Shortage Occupation List?
My previous CoS didn't mention about whether my Job comes under Shortage Occupation list or not. My SOC code was 2136 and when I searched in UKVI with this SOC code it says that it's under Shortage Occupation list. So, can I say “Yes” to this?

Q3). Length of Certificate of Sponsorship grant?
Do I need to provide Length of my LAST CoS (i.e. 3 years) even though I am currently on ILR?

Q4). Can you please advise if I need to give the proof of cohabitation?
During application filling, I can't see this document to send, So, Do I need to provide this?

Q5). Maintenance Funds ?
Is it OK to provide my bank statements to show Maintenance Funds as My wife didn't have enough funds on her bank account?

Hi CR001,

I am currently filling Tier2 Dependent Extension Application form for my Wife and Children.. At the end (in the mandatory documents section) it asking to provide for below... I wanted to check with you that whether what I am providing is correct ?

1. Proof of Mrs XXXX's relationship status as the married or civil partner of Mr XXXX
Is that be OK if I show marriage certificate ?

2. Document showing you and your partner are living together (for example, a utility bill, council
tax bill or bank statement)
My wife's name and my name is there only on Water Bill.. is that be sufficient ?

HO will expect to see utility bills, council tax, official letters from HMRC or DWP etc, TV licence, Tenancy agreement, NHS letters, DVLA letters etc etc etc.

You need more than just two letters.

You need evidence for every 3 to 4 months covering 2 years from at least 3 sources if in joint name and at least 6 sources if addressed individually.

Just a small question.. In single application form, I am adding my wife and also 2 dependent children...

How do I need to pay IHS fee ? like
a. I need to pay 3 times (and enter 3 IHS numbers in the application form)
or
b. just pay one time for all members and enter one IHS number?
