Question if anyone knows:

Does the time spent under Tier 4 (student) visa before switch to EEA family member counts towards the EU Settlement scheme?

No it's in the Caseworker Guidance . " where they have completed a continuous qualifying period of residence in the UK and Islands of 5 years – as a relevant EEA citizen, a family member of a relevant EEA citizen "

Thank you for this askmeplz82.

You know, I suspect that some people at the Home Office are telling a lot of non sense. Someone I know called them and they told him he can apply for Settled status using his years as T4 student!

It doesn't make any sense by they are giving incorrect advice.

My timeline so far.

Non EU citizen married to Irish citizen. Separated but still married.

Moved to the UK back in 2014. Granted with a Residence document vignette in my passport valid until 1st August this year.

On 8th of July 2019 went for biometrics.

Still waiting for a CoA. No email whatsoever from them. I called them they said the 4 days processing time on the website is for the EU nationals. Non EU nationals takes longer (no indication as to what "Longer" actually means).

My children are british citizens through their mother (Her dad is English)

My wife is Irish so no need for her to apply.

Anybody experiencing delays. If possible anybody who is married to an Irish citizen could you tell me if you were required to prove your Irish spouse's 5 year residence, work, ID etc...? Im asking because we're separated so don't actually have the full documents for her Tax only some years. Although they didn't ask me this anyway.

Would love to hear from Non EU citizens married to Irisih citizens.

Thank you

Hi everyone,

Eu Settlement Scheme : 06/06/2019
Biometrics: 10/06/2019 (Croydon)
COA: 11/06/2019
Pre-Settled Status: 16/07/2019
BRP: Processing (in 7 days)

I am spouse of EEA citizen who got Settled status 01/04/2019. I called to Resolution Center 12/06/2019 to ask "is that anything wrong.". Officer said that "Everything seems OK. I'll inform HO to able escalate your process.". It worked.

Good luck to everyone.

I didn't send anything at first except photocopy of her ID . I am not living with her for 5 years now ( separated ) . She didn't apply and she will not probably after UK leaves the EU that what she told me . Yes Long time. Can you imagine my RC expired in 2015 and since then I couldn't go anywhere outside and I couldn't apply PR because my Ex stopped working and she won't give me any documents.

Hi there

Anyone else on here who has been waiting for a long time. I entered my BRP details in my application on 31.3.19 and since then was informed it was an error. Invited for biometrics on 14.06.19 and attended on 19. 06.19 and since then still no COA or any further communication. I emailed them last week and was informed that my application was submitted successfully but they cannot say how long it will take them to finish reviewing it.

Hi all,

Is there anyone here apply for pre-settled status through EU Settlement Scheme based on EEA Family Permit and have not received CoA or any update more than 2 weeks after biometric?

Numerous calls to Resolution Centre has been made, but ofc response was generic. Everything is fine, information is all here, you will hear from us soon.

I wonder if it is only me and what could be the reason, other than being non-EU ofc

I am pretty much sure you will get settled status. Just wait.

And when you will get a new passport. Just inform HO to update there record. As BRC and status are connected to your passport with which you have given biometric.

Good luck.

Hi,

We spoke before on this forum. And we are in the same situation regarding applying for the EU settlement scheme with BRP and not BRC. Please read my time line below and my comments which I hope it will make you and anyone in the same position feel better.

May 1st: Applied online using BRP
May 3rd: EU settlement scheme department received my BRP
May 25th: Received back my BRP by mail
June 20th: Received a letter by mail from home office asking me to do my biometrics at the post office (did my biometrics same day)
July 12th: Received my decision letter (pre settle status)
July 17th: Received my new residence card.

Notes:
- In the beginning of the application, it asked which document I will use to prove my identity? Passport or UK residence card?. I selected UK residence card and entered my BRP details. The EU settlement scheme team told me the reason why my application was taking long is because I entered my brp details and selected UK residence card which means BRC and not BRP).

- I did not receive a COA. I am not sure but I don't think its important. I received the decision letter by email after my biometrics

- The people who works at the EU settlement scheme department are very nice. Please just listen to what they say to you. And keep checking with them from time to time.

- Each person has his or her own application case. Not everyone is the same.

- Do not worry

Hi guys,

Please if someone here has applied to the EU scheme based on his relationship to an Irish citizen I would really love to know how they got on with their application.
My issue is that me and my wife are separated for a long time now (3 years) but still married. I do not have any document to prove her residence in the UK and she won't help me by giving me any document.

Our kids are British citizens and hold british passports.

Being Irish citizen she doesn't need to apply and she probably wont apply because she was born here anyway but Im scared if they ask me to provide a proof of her living in the UK I cant prove that. She doesn't work so Im thinking even if they check her records they wont automatically be able to do so through her tax etc...

I have some documents of her tax from before we separated but they're old documents from 2014-2015

Im thinking since she is an Irish citizen she is automatically settled so I dont need to prove that to them. So far they didnt ask me anything yet but Im trying to think ahead in case they ask me for this and would love to hear from anyone who is in the same situation as me or who applied based on their relationship to an Irish citizen.

After numerous calls and few emails to EU Settlement Resolution Centre, I heard something back from HO.

Here is my timeline:
Entering UK with EEA Family Permit accompanying EEA spouse dated on 29/05/19: 09/06/19

Submit online application under EU Settlement Scheme: 12/06/19
Biometric: 03/07/19 (paid £60, nothing free near me in Leeds)
CoA: 19/07/19 at 8.50 am
Decision of pre-settled status: 19/07/19 at 10.08 am

I wish everyone good luck with your application. Be persistent and proactive to HO if you think your case is straightforward.
