Dependent visa & IHS Surcharge refund queries

Dear all,

I am currently on dependent visa (my spouse is the main Tier 2 general visa holder).

My visa is expiring next month therefore, I am in the process of applying for my last extension before getting eligible for ILR( i.e next year in September).

As I will be applying for ILR in September 2020, I be in this new dependent visa for 13 months only (i.e from Aug 2019 to Sept 2020).

However, my spouse's Tier 2 general visa has been recently extended until August 2022 (3 years).

Therefore, as a dependent do I need to make this application for 3 years or can I choose to apply for less than that, as I will end up paying less IHS surcharge?

If I happen to apply for 3 years extension, can I get a refund for the excess IHS surcharge which will be unused in this visa after I get my ILR?

Your answers will be much appreciated!

Your visa will have the same expiry as your partners visa. You cannot choose a lesser time.

IHS is not refunded when you apply for ilr.

I am in middle of applying for the extension and I am slightly puzzled about the IHS surcharge.

I understand that, my new visa's expiry will be as of my partner's which is 20th Aug 2022.

However, my current visa is expiring on 15th August 2019.

I dont understand why I am asked to pay for £1400 instead of £1200(for 3 years) ?

Is this because my partner's new visa expiry is 20th Aug 2022 which is 3 years + 5 days from my current visa expiry date(15th Aug 2019)?

It is £400 per year or pro rata for part years in 6 month intervals.

This means they are charging me £200 for the extra 5 days?

Which is unfair, as my partner's previous visa was valid until 15th August 2019.

When she applied for extension, she paid £1200.

Although, her new COS mentioned that her new employment is until 6th Aug 2022 only but home office gave her until 20th August 2022, instead of 15th Aug 2022.

Now, if I am charged for extra £200 for extra 5 days as my current one is expiring on 15th Aug 19 and the new one will be extended until 20th Aug 2022.

I am not sure what is the best course of action I should take in this situation as I am applying for myself and my son?

Therefore, its £400 extra that we are ending up paying.

Apply closer to your visa expiry date then and it should hopefully be 1200.

I thought about that, but we have paid the surcharge until the current expiry date.

Should they not calculate from the current expiry to number of years we are applying to stay?

No as the date of application is the date you submit and pay online, regardless of when your current visa expires.
