Help - Spouse Visa, Extended Twice and now ILR

Post by latino4ever » Fri Jul 26, 2019 9:31 am

Hello to all,

I have a question on how soon I can apply for ILR after a second renewal to extend the time to pass the life in the UK test. My case also involves a refusal which i will explain below.

5 year route spousal visa:

2.5 Years issued on 18/11/2013 entered the UK on 14/12/2013 expire 18/08/2016
2.5 FLR M Renewal issued 28/07/2016 expire 25/02/2019
2.5 FLR M extension need to pass Life in UK as cant apply for ILR yet. This visa was refused "due to not meeting A2 requirement HO change made in 2017" which I appealed, however during the appeal I passed the B1 (in preparation for ILR) and submitted a new application and withdraw my appeal. my visa has now been approved issued 17/07/2019 expire 17/01/2022

My question now is if i pass the life in the UK test today and I meet all the other requirements for ILR, how soon can I apply for ILR.

Any good constructive guidance and support welcome and furthermore if backed up by evidence.

Thank you all

Read upon immigration rule 39E. Re- Applying within 14 days of withdrawing an appeal.
You should be able to apply immediate if you fulfil all requirements.. You’ve completed 60 months.
I’m surprised that you didn’t take LIUK during appeal time with the English exam and simply applied for ILR instead of flr m again.
