Reckonable Residence Calculation

Post by takeabow » Thu Jul 25, 2019 9:35 pm

Quick question with (hopefully) a quick answer

NOTE: THIS DOES NOT APPLY TO THE 12 MONTHS PRECEDING THE APPLICATION, WHICH IS SUBJECT TO THE HIGH COURT JUDGEMENT

When calculating reckonable residence over the 5 year period (spousal route) is it only the days per year IN EXCESS of 42 (6 weeks) that are deducted from the reckonable residence, or the total days (if over 6 weeks).

eg. if i am away for 100 days in a year (and declare all of those absences in form 8, as requested), how many days are deducted from reckonable residence that year - 100 or 58?

Many thanks!

Asked the same question to the citizenship department through email and their reply was:

"Absences totalling 6 weeks or more in a 12 month period will be deducted in
their entirety when calculating reckonable residency."

According to the response it would be 100 days deducted from the residency.

This was last year so worth emailing them as well as you never know what reply you get from them.
