I just had an email back from the solicitor i have hired to help with our fiance visa application. Hes just told me that the chances of us being rejected are very high as i have not seen my finance in 15 months now ( i do have reasons for this). he aslo said he is still willing to help us but that their firm will not sign our application and submit it to the embassy as they do not want to break thier firms 100% record.

Wow so that makes me feel like why am i even bothering??!!! even the professionals think its a waste of time.

My love and commitment to this realtionship just doesnt seem enough.

So the solicitor is being honest, doesn't mean what he did for you is no good, so go for it.

A lot of us couples are separated for long lengths of times, never give up it is never a waste of time.When you submit your papers just give all the evidence you have of the contact you have both had. If the worst thing ever happened and you have to appeal at least then you get to explain everything to the judge who will have to listen to your reasons which are very reasonable. Keep your chin up.

Like lesley15 said, alot of us are separated from our love ones for a period of time.

Maybe when you submit your application, you may want to write a cover letter explaining why you have been separated for 15 months? You can prove that you are very much still in the relationship by submitting proof of calls/emails/ greeting cards/ photos/ phone bills and etc. You will need to convince the ECO that you are in a genuine and durable relationship.

Do you really need a solicitor to apply for the fiance visa?

Tammy, I agree with ribena, the "evidence of contact" is very important here. Simply, how have you kept in touch, and what evidence do you have about that?

Also appreciate that the Immigration Rules merely say, as regards this issue, that the couple must have met, and clearly you have done that, but the ECO also needs to be satisfied that the relationship is genuine, and will not lead to a marriage of convenience. Hence the need for the "evidence of contact".

Tammy, where is your fiancé going to be making the application?

It sounds like your/adviser solicitor is not able or willing to deal with complex cases, and only sticks to extremely safe in-rule cases that are as near guaranteed as can be.

As others have said here, the separation issue can be argued and 15 months is not comparable to the years that some have had to spend apart.

To be refused solely on the grounds of a long period of separation would certainly raise Article 8 issues.

If you are worried, then get yourself a specialist or someone with a bit more experience.

Hi

I feel your pain. I am in a similar situation. I havent seen my husband for over a year now. I have submitted my application, its been about 13 working days now. However, to prove that we are still in contact, we submitted international calling cards, emails, letters and cards, covering most of our relationship (i.e up till the day we submitted the application). I also explained why my husband has not been able to travel to come and see me.
Sometimes couples are unable to see each other regularly, be it work commitments, or simply because of finances.

Dont worry too much. I think as long as you provide as much info a possible it shouldnt be too much of a problem.

Good luck, and I will keep you posted on how we get on.

Hi

I just heard that the BHC is still running checks on my passport. Can anyone tell whether this is a good sign?

Its been 5 weeks now... :cry:

How does one run checks on a passport?

I am wondering the same thing. But that is what I was told by a lady over the phone. I took it to mean that the application had been referred to the UK.....or something along those lines.

Could this be the final stage? For those in the know... :)

Hi,

After 5 weeks of daily phone calls, guess what....I got the visa!!!! I am so thrilled, over the moon, ecstatic......I cant even describe it!!!! I cant wait to see my husband again.

Thanks to everyone for their invaluable advice...couldnt have done it without this board!!! :D
