Hello
My wife has 33 months residence permit (which expires in August 2019) as family member of Me (I have PR for 4 year). She is continuously living and working full time in UK since November 2016. She has received her current visa( permit) overseas.

We would like to apply for new visa( residence permit) in July .
Would it be same application we had done before or is it any different ?
What’s the fee and requirements?

Topic moved to the family immigration sub forum as not relevant to the eea EU sub forum.

She has a VISA under UK immigration rules, not a residence permit under the eea rules. You have ILR under the UK immigration rules and not PR under eea EU rules. There is a big difference and different rules.

She applies for an extension on form FLR M, meeting the same financial requirement and English A2. Plus evidence of 2 years cohabitation.

Current fee is £1033 for standard application plus £1000 IHS fee.

I have PR( previously was married to Eu citizen ,hence optain PR in 2015).

Coming back to my wife, she has past the English test A1 , in 2016 in order to apply for her visa .

Does she need to pass it again?
What could be a proof of our 2 years cohabitation ?

Hello again

As it a little bit confusing for me. I am thinking that extending existing visa ( family member of permanent resident permit) should be more easy and straight forward. But looks like it’s not .

1) she would need to proof again her knowledge of English (previously it was A1) now it has to be A2?

Both of us from outside Eu , I have PR (from my previous marriage). She received her visa in November 2016 from overseas,we submitted our divorce certificate then, do we need to submit it again?

3) she was applying online , printed out application and sent it to visa centre , she had an account there, would it be the same one or she need to create different one?

Sorry if those questions sound naive , we just trying to get ready beforehand for the process

Within 28 days before the 2.5 year residence mark counted from the date she entered the UK or before her visa expires.

Unless personal circumstances/visa fee/rules not changing then preferably extension should be applied very close to visa expiry for enjoying the full length of visa and avoiding any shortfall towards ILR in future.

I was counting toward it too,but put into consideration that the first visa was issued for 33 months and time it takes to process it (around 6 months ) then both visa combaining would be just over 5 years, obviously there is a gamble here to that Ukba would process it within a month.

So if current visa expires 20/08 the earliest she can apply is 23/07 ?

She entered U.K. 20/11/16 , then 2.5 years will be 20/05/19 , take away 28 days would make it 23/04/19 she can start the process ?
Are my calculations correct?

We ( my wife and I) preparing documents mad proofs for my wife visa.
Both of us originally from outside Eu, I have permanent residence ( I was married to Eu member).
My wife obtain her first visa in November 2016 for 33 months from outside the uk ,it will expire 19/08/19.

I have few questions and would be grateful if they are answered ( sorry in advance if they will sound silly)?
1. There is a link where to start the process , I have followed it and it is says “partner” is it same as a spouse ?
2. Divorced certificates from previous relationships ( both of us were married before) , I have mine , how about hers , I understand it has to be translated , does it has to be certified translated or can it be just translated and attached to original ?
3. English knowledge,
last time she has submitted A1, she need A2 or above? It’s has to be from specific collages I guess , if you could please provide a link for them.
4. As a proof of our relationship we are planning to submit few bank, bills for 2016,2017,2018,2019 would it be sufficient or there are specific requirements for it?
5. Affordability “
My current job is “0” contracts and I earn less then 12k , but my wife is on “0” contract ( working from November 2018) and her salary is over 20k , would it be if we stated that ( with payslips and contract, bank statements) or it has to me who has 18.6k salary ?

I understand that there will be more information in the form , but is it any other “hidden”points we have to look at ?

2. Just translated. You must have attached it in previous application and same will be accepted now

3. A2/B1 ielts life skills

4. 6 piece of documents in joint/individual named from the last 2 years. Any letter can be used.

5. You both can combine your incomes but if either of you alone can meet the requirement then preferably use his/her income alone to keep involve the less paper work.

Few more questions
1). Which collages can she use to get that certificate? I remember it has to be specific ones?
Where can I get information for it, we just want to book an appointment and be ready , as sometimes it takes few weeks to get one and we are worry that it might be too close to visa expiration date (19/08/19)
2). They are asking for email address .
last time she used email address to submit for the visa , does it need to be same one or “new” is fine ?

I have a question reguarding “good knowledge” test
I have followed the link on recommended exam bodies and saw that a2/b1 test from trinity collage is only valid for 2 year, but IELtS from British council has not got expiry date or is it same 2 years ?
Just want to know , if it’s better to apply for ielts exam , just to avoid doing same B1 when applying for indefinite leave to remain ?
I would be great full if you explain

All English tests carry date of expiry. Preferably pass B1 which is very similar to A1 & A2 by preparation & cost wise. Even B1 will be expired in 2 years time but still will be accepted if it remain on the HO list.

1 Just want to make sure that I have understood it clearly ,
My wife passes B1 and it’s valid for 2 years , and when she is applying for permanent residence/indefinite leave to remain , which probably be in 2.5-3 years time , she will need again pass same B1( or whichever equivalent HO will decided is needed) ?

On separate matter

We are filling in the form and there is one question
In “partner basis for living in the uk”

“Was your partner ever given a visa or leave as the partner of a settled person”?
Well it’s me,
I was married to Eu sitizen 2009-2014 , then divorce , retain my rights , then applied and revived permanent residence
Do
I need to tick “yes” box there ?

I we will do and I separately explain and provide proofs

She is working at current work since November 2018 ,( 9 months ,salary 20k plus bonus)
It was mentioned that she needs to provide 12 months of statements,
She can provide headed letter proving it , what about payslips , she can only provide for 9 months but as she get paid weekly it will be a lot of them, what should we do here?

Sorry as it might be naive question but want to be correct with it, as we had bad experience with previous visa application , when we made mistake and it was refused
