T1 Ent Settlement : job creation query

Hi everyone

I am planning to apply ILR based on 5 years of T1 entrepreneur visa.
I have maintained 2 full time jobs since last april 2018.

My question is

If I apply on 30th of July, do I have to send payroll information from 1st of July 2018 to 30th June 2019 ? or do I have to run July 2019 payroll and include that information while applying ?

Basically, from the date of application for settlement, what's the requirement for payroll ? how many past months do I have to send.

Ideally, I want to apply around 30th of July, its been 5 years and 6 months that I am on T1 Ent visa.

You will fall under the exception rule then. The day you will apply you can only claim for 12 months immediately before the date of application.

Given your extension is approved on 11th April 2019.
Lets say you apply on 27th July 2019. You can only claim from 27th July 2018 - 26th July 2019. You need 12 months in that period.

If you want to claim for period 1/7/18 till 30/6/19 you must apply on 1/7/19 and no later.

Good catch. I misread it as April 2018.
So, in this case, it has to be 12 months before. So if applying on 30 July, the month of July has to be included.

@OP

Normal rule: 2 FT jobs AFTER extension that existed for 12 months each.

Exception rule: IF date of ILR application is less than 12 months from date of extension, then you may claim for 2 FT jobs that existed immediately 12 months before the date of ILR.

Ok gurus, I have filled my application form and here s the list of documents that UKVI has asked me provide

Mandatory documents
My passport

Other documents

Companies House documentation to demonstrate your registration
My Life in the UK Test pass notification
Employee Payment Records, original HM Revenue & Customs P45 or P46
For directors of a company - a printout from Companies House of the company's filing history
page and of a Current Appointment Report to show that you are/were a director of each
business for the period
Real Time-Full Payment Submissions
The degree certificate to prove the level of English language required

Evidence of My immigration status in the UK (what evidence do I have to provide here ?)

Declaration signed by Me to confirm consent for the Home Office to request verification checks

Current Biometric Residence Permit

So my question is

I cant see business bank statement in this list.

is it mandatory to provide business bank statement ?

or is it up to me if I want to send

Actually I want to send minimum documents ... however, I can provide business bank statement if its a must.

my second question is

they are asking me.

Evidence of My immigration status in the UK

What evidence they will be looking for ? I am going to provide them with my passport and BRP

what else I can provide to give them .... Evidence of My immigration status in the UK ???????????

BRP is the evidence of immigration status..
Bank statement is not mandatory.
Send a bank confirmation letter instead- recommended! For business registration
EPR and P60s p45 not required docs at this point.
Send CT600 CT41G and PAYE reference letter. For business registration.
Employee IDs right to work and payslips

I can understand that I have to include two job descriptions for employees and one job description for myself, the director.

Do I have to send employment contracts as well ? Employment contracts with employees ?

My accountant ran payroll on 31st of July 2019 and I applied online on 1st of August. I got appointment on 14th of August in Croydon centre.

I understand that I have to scan documents myself.

Can I upload documents before 14th of August ?

I just want to ensure that I carefully check all documents before uploading.


Tax documents, FPS, salary slips, CT 600 etc are on pdf. If I am uploading these documents, do I have to print them again while I am on my appointment, on 14th of August ?

When I am going for appointment on 14th of August, what documents in hard copy I must have ?

I have the checklist of documents from the UKVI website.

This checklist says that I must send P45 and P46 forms.

P46 forms are specified on the checklist, I asked my accountant for them but he informed me that those P46 forms are no longer used. They are discontinued long time ago by HMRC.

What shall I do ? Shall I just skip P46 forms ? or is there any alternative forms that I should send ?

Please guide me.

For job creation:

It is showing in the checklist because you have ticked that option while answering the original question in the online form. The question clearly states to tick only what is applicable to you. P46 or P45 is not needed but you have incorrectly selected that in your answer.

Neither P45 or P46 are required documents when you have RTI FPS. Not sure why it ends up in the checklist - one reason could be due to the date you entered in "when you started RTI" question. Or it could simply be a mistake.
