ILR (Tier 2 Gen) - Dependent extention

Hi CR001,

My partner was granted a 1 year Tier2 Gen dependent PBS visa in Sep 2018 which is expiring next month. So, I'm planning on applying for Tier2 Gen dependent PBS extension for my partner where she needs 4 years to eligible for ILR application.

My Visa Status: ILR - Dec 2024 (Switched from Tier 2 Gen - Tier 2 expiry 2nd Sep 2019)
My Partner's: PBS dependent Visa expiry 2nd Sep 2019

I have a question regarding the visa application.

1) when filling the application form I came across this section where they are asking for the length of COS.

Question: Length of Certificate of Sponsorship grant. What is the length of Mr X's Certificate of Sponsorship (CoS)? (Required).This information can be found on their Certificate of Sponsorship (CoS)
Options: (1) 3 years or less (2) more than 3 years

Fee deference:
(1) up to 3 years - £704
(2) More than 3 years £1,408

Ideally, my partner needs 4 years to eligible for the IRL application. However, you have advised me on other thread that, it will be a 3-year extension whether we pay 5 years of IHS Fee.

I'm bit confused here whether I need to choose option 1 or 2. because the price difference is more than a double.

It is based in your last cos you had and is really only for link and reference purpose and nothing to do with how long she will get a visa for. If your last cos was 3 years, that is what you state or if it was more than 3 years, you state it as such. She can only get a 3 year extension as stated in the immigration rules.

She will need another extension to cover the shortfall later on before she can apply for ilr.

1st COS: Start date: 08 September 2013 End date: 07 September 2016
2nd COS: Start date: 08 September 2016 End date: 07 September 2019

So, do I need to choose option (1) 3 years or less

Will it be a 3 years visa extension or 2.5 years visa?

Your LAST cos was for 3 years so that is what you choose yes, option 1. It is not asking for all cos combined!

As advised twice already, a PBS dependent visa extension is granted for 3 years as stated in the immigration rules.

There is no 2.5 year pbs dependent route. You are thinking of a completely different visa category.
