Hello,

I am asking this question for a friend. His girlfriend had arrived in the UK on a marriage visitor visa, valid for 180 days out of which she is permitted to remain in UK for 90 days.

Now, based on this visa she in the UK and have already marries her partner who is working here on a PBS Tier-2 visa. The marriage is formally registered.

As her visa is still valid, she wants to temporarily leave the UK and re-enter next month again, at which point she will be applying for a PBS dependent visa.

Her question is if she can leave and re-enter on the marriage visitor visa even after she has legally registered the marriage, considering that her visa is still valid?

She may not be able to re-enter since the purpose of marriage visitor visa has already been fulfilled. She also cannot switch into any visa from UK.

I know you didn't quite ask this, but she cannot apply from within the UK for a PBS dependent visa. She needs to apply for entry clearance as she cannot change from a visitor visa (even a marriage visitor visa) to any other category.

A marriage visitor visa is multi-entry, but if they ask her plan and she says to apply for a PBS dependent visa, she will be told she cannot do so. They may then suspect a risk of overstay... Additionally, the purpose of the visa will have already been met, so not sure how that would impact the ECO's risk assessment of her either.

My recommendation is that whatever you told the Home Office when you applied for spouse visa, do it.

Changing plans short term is usually a trigger for issues with immigration.
