Travel during job switching period

Hi all,

I have a question regarding my partner's visa status. He is currently on a Tier 2 visa and I'm on Tier 2 dependant.

He has received a new job offer and his new employer is working on his COS. They already passed the LBMT so they just need to submit the COS application on the 5th of September.

My partner has handed in his notice after he received the offer, which requires him to work for 6 more weeks as stated in his contract. His last day will be somewhere in the third week of September.

We have planned a trip to travel around Europe for 2 weeks, flying out early next week.

He has the offer letter from his new employer and he still has to finish off the remaining time at his current company when we return from holiday.

I just wonder if it's safe for us to travel outside of the UK during this time. It's my understanding that employers can only notify via COS management system within 10 working days after the migrant's official departure date.

You seem to have a misunderstanding. Your partner cannot use an RCoS as he would then have to apply outside the UK and would be subject to the 12 month cooling off period.

He requires an unrestricted CoS to SWITCH employers within the UK.

He can travel as long as he has not submitted a new application yet.

Thank you for your reply,

I did a quick search and you are absolutely right. I will ask my partner why did the new company say we have to wait till early September (I assume it's the 5th because I wrongly thought that he will need the restricted COS)

Can I bother you with another question?

I'm not very familiar with the COS management system. Can his current company notify/leave a note in the COS system about the departure date in advance or they can only do so after he left the company? I'm just slightly nervous as he has been having problems with the company for quite some time.

His current employer only informs ho within 10 days AFTER his last day of work. They don't do it before.
